PREFACE

The Lewiston Code was originally prepared by Municipal Code Corporation (Tallahassee, Florida), completed in January, 1976. Periodic supplements have been prepared at regular intervals, keeping the code up-to-date. Code Publishing Company (Seattle) reformatted, edited and reprinted the complete code text, tables and index in January, 1993.

The code includes all ordinances of a general, permanent or public nature, or those imposing a fine, penalty, or forfeiture. Tables at the end of the code list all codified ordinances, with notation as to which code sections were amended, repealed, or added. This edition of the code includes enactments through Ordinance No. 4039, passed April 20, 1992.

Code chapters are arranged in alphabetical order by subject. Sections within each chapter begin with bold catchlines and conclude with a history note: the legislative source enclosed in parentheses (). Section numbering consists of two parts: first, the chapter number followed by the section number, separated by a dash (-). For example, the fourth section of Chapter 19 is number 19-4. Index entries are keyed to the section numbers.

When a section of the code is repealed, the number is reserved and an editor’s note added for historical recordkeeping.

A Table of Revised Pages informs the user whether the code volume properly reflects the latest printing of each page.

The complete new Index includes both direct entries to every code section and useful cross-references commonly found in municipal code publications. In addition, the code text together with search retrieval software is available for desk-top computer access. In the automated format, every word, phrase and number is effectively indexed.

ORDINANCE 4065

AN ORDINANCE RECODIFYING THE GENERAL ORDINANCES OF THE CITY OF LEWISTON, IDAHO, ALL PURSUANT TO IDAHO CODE SECTIONS 50-903 THROUGH 50-906; AND PROVIDING AN EFFECTIVE DATE.

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF LEWISTON IDAHO, AS FOLLOWS:

Section 1: There is hereby adopted and enacted the “Code of Ordinances of the City of Lewiston, Idaho,” published by Code Publishing Company of Seattle, Washington, a looseleaf copy of which is on file at the office of the City Clerk, which code shall be treated and considered as a new and original comprehensive ordinance which shall supersede all other general and permanent ordinances passed by the City Council.

Section 2: That all the provisions of such code shall be in full force and effect from and after the 1st day of March 1993, and all ordinances of a general and permanent nature of the City Council, enacted on final passage on or before March 1, 1993, and not in such code or recognized and continued in force by reference therein are hereby repealed from and after the effective date of such code, except as hereinafter provided.

Section 3: The repeal provided for in Section 2 of this ordinance shall not affect any of the following:

(1) Any ordinance or resolution promising or guaranteeing payment of money from the City, or authorizing the issuance of any bonds of the City or any evidence of the City’s indebtedness, or any contract or obligation assumed by the City.

(2) Any administrative ordinances or resolutions of the City Council not in conflict or inconsistent with the provision of the code herein authorized.

(3) Any right, contract, or franchise granted by any ordinance of the City.

(4) Any ordinance providing for appropriations of the City, levying or certifying taxes and providing for a local improvement district and assessments.

(5) Any ordinance extending or establishing the boundaries of the City.

Section 4: That any and all additions and amendments to the Lewiston City Code, when passed and adopted by law, shall be deemed to be incorporated in the Code herein adopted.

Section 5: A copy of the Code of Ordinances, herein adopted, shall be kept on file in the office of the City Clerk and shall be available for all persons desiring to examine the same during regular office hours.

Section 6: This ordinance shall take effect and be in full force from and after 12:01 a.m. on March 1, 1993.
