2.20.010 Department of Public Safety.
The Department of Public Safety shall perform all of the duties and responsibilities for Police and Fire Service in the City of Gardner, and shall have all of the powers, duties and responsibilities conferred upon Police and Fire Service by virtue of the Code of the City of Gardner, Kansas, ordinances of the City of Gardner, and shall have such other and additional powers, duties and responsibilities as may be lawfully imposed upon it by any administrative directives, resolution, rule, ordinance, charter provision or statute. 2.20.020 Director of Public Safety.
The Director of Public Safety shall be the administrator and head of the Department of Public Safety. Said Director of Public Safety shall have all of the duties, responsibilities and functions conferred upon a Chief of Police and/or Fire Chief, as such terms are commonly used. He/she shall, in addition thereto, have such other powers, duties and responsibilities as shall from time to time be lawfully conferred upon him/her by the Governing Body of said City, and by law, and whenever any statute, ordinance, municipal regulation or law shall require a duty or responsibility of the Chief of Police or Fire Chief, such duties and responsibilities may be assumed and performed by such Director of Public Safety. 2.20.030 Appointment of Director of Public Safety.
The Director of Public Safety shall be appointed by the Mayor with the approval of the Governing Body. (Ord. 1556 § 1. Code 1990 § 1-403)
2.20.040 Chief of Police and Fire Chief.
Considering the recommendation of the Director of Public Safety, the Mayor shall appoint, with the consent of the Governing Body, a Chief of Police and a Fire Chief along with other such officers in each department as shall be deemed necessary by the Mayor and Governing Body. 2.20.050 Police Department.
There is hereby established a Police Department in the City. The Police Department shall be a part of the Department of Public Safety. The Police Department shall perform all of the duties and responsibilities for Police Service within the City of Gardner and shall have such other and additional powers, duties and responsibilities as may be lawfully imposed upon it by administrative directive, resolution, rule, ordinance, charter provision or statute. 2.20.060 Police membership.
The membership of the Police Department consists of a Chief of Police and not less than four full-time Police Officers. Additionally, there shall be a Police Reserve unit consisting of not more than 10 volunteers. All personnel shall be appointed by the Mayor with the approval of the Governing Body. (Ord. 1556 § 2. 2.20.070 Police salaries.
The Chief and full-time Officers shall be paid in accordance with the salary ordinance established by the City Council. Reserve Police Officers shall receive no salary nor City employment benefits. They shall, however, be entitled to all benefits mandated by federal or state statute or administrative rule or regulation. (Ord. 1556 § 2. Code 1990 § 1-407)
2.20.080 Police Chief duties.
The Chief of Police shall be under the administrative supervision of the Director of Public Safety. The Chief of Police shall have operational control over the Police Department, the full-time Officers, reserve Officers, Police clerical employees and all equipment issued to the Police Department. The Police Chief shall ensure that all Department equipment is properly maintained and accounted for. The Chief of Police shall ensure that all statutorily mandated training for full-time and reserve Officers is accomplished on a timely basis. (Ord. 1556 § 2. Code 1990 § 1-408)
2.20.090 Discipline.
The Chief of Police shall be responsible for discipline and conduct of all Officers and Department employees. An internal affairs policy shall be established and followed. (Ord. 1556 § 2. Code 1990 § 1-409)
2.20.100 Fire Department established.
There is hereby established a Fire Department in the City. Said Department shall be a part of the Gardner Department of Public Safety. The Fire Department shall be responsible for the suppression of fire, and any other tasks assigned to it by the Mayor and Governing Body, within the City fire boundaries limits. (Ord. 1556 § 3. 2.20.110 Fire membership.
The membership of the Fire Department consists of a Chief, Deputy Chief, four Hose Captains, two Engineer/Truck Captains and not less than 10 nor more than 35 volunteers. Full-time employees of the City of Gardner may perform fire-fighting duties. All personnel shall be appointed by the Mayor with the approval of the Governing Body. (Ord. 1556 § 3. Code 1990 § 1-411)
2.20.120 Meetings/policy.
Members of the Fire Department shall meet at least once a month for practice drill. The Chief shall recommend such policies as may be necessary for the efficient operation of the Fire Department to the Director of Public Safety. (Ord. 1556 § 3. Code 1990 § 1-412)
2.20.130 Fire salaries.
The Chief, Deputy Chief and all Fire Captains shall receive a salary as provided by City ordinance. All other volunteer personnel shall receive $5.00 per fire or meeting. (Ord. 1556 § 3. Code 1990 § 1-413)
2.20.140 Fire Chief duties.
The Chief of the Fire Department shall be under the administrative supervision of the Director of Public Safety. The Chief shall have superintendency and control over and be responsible for the care and condition of the fire apparatus and equipment. It shall be the duty of the Chief to see that all such apparatus and equipment be at all times ready for immediate use. The Chief shall submit a written report as to its condition to the Director of Public Safety, Mayor and Council at their first meeting in January each year. (Ord. 1556 § 3. Code 1990 § 1-414)
2.20.150 Discipline.
The Chief of the Fire Department shall be responsible for the discipline of members, and is hereby given the authority to suspend any member for the refusal to obey orders or for misconduct or failure to do his/her duty at a fire. As soon as possible thereafter the Chief shall submit a written report along with recommendations to the Director of Public Safety. The Director of Public Safety and City Administrator shall review the report and recommendations of the Chief and take the appropriate course of action using the City personnel rules and regulations as a guideline. The Chief shall also have the right to summon any and all persons to aid in extinguishing fire, or to aid in removing personal property from any building on fire or in danger thereof, and in guarding the same. 2.20.160 Control at fires.
The Chief of the Fire Department shall have full power, control and command over all persons present at fires, and shall direct the use of all fire apparatus and equipment, and command all firemen in the discharge of their duties. He/she shall take such measures as he/she may deem necessary in the preservation and protection of property and the extinguishing of fires. (Ord. 1556 § 3. Code 1990 § 1-416)
2.20.170 Records.
The Chief of the Fire Department shall keep in convenient form a complete record of all fires. Such information shall include the time and location, construction of building, owner, occupancy, how extinguished, value of building and contents, members responding to the alarm, loss on building and contents, insurance on building and contents, and any other information deemed advisable. The Director of Public Safety shall be responsible for ensuring that the information provided by the Chief is sent on a timely basis to the Kansas Uniform Fire Information Reporting System in such form or format as KFIRS shall provide. 2.20.180 Fire inspection.
It shall be the duty of the Chief of the Fire Department to adopt all prudent measures for the prevention of fires, and for this purpose any employee under his/her direction may, upon request or whenever he/she has reason to believe that the safety of life and property demands it, and as often as he/she may deem necessary, enter any building, yard or premises in the City during reasonable hours for the purpose of inspection, and where dangerous, unsafe or hazardous conditions are found to exist, he/she shall give such directions for the alteration, change or removal, or better care or management of the same as he/she may deem proper, and such directions shall be obeyed and complied with by the person directed in that regard and at their expense. 2.20.190 Absence of Fire Chief.
In the absence of the Chief, the Deputy Chief shall perform all the duties and have all the authority and responsibility of the Chief as conferred by this chapter. (Ord. 1556 § 3. Code 1990 § 1-419)
