9.10.010 Right-of-way, apparatus.
All fire apparatus and equipment is hereby given and granted exclusive right-of-way over and through all streets, avenues, alleys and public thoroughfares in said City while en route to fires and in response to any alarm of fire, and no person or persons shall in any manner obstruct or hinder said apparatus as aforesaid. Such fire apparatus shall be operated in a reasonable and prudent manner in accordance with the Standard Traffic Ordinance for Kansas Cities adopted by the City of Gardner as its traffic ordinance. 9.10.020 Driving over hose.
It shall be unlawful for any person or persons to drive any wagon, carriage, automobile, truck, locomotive, railroad car or any other vehicle over any fire hose laid in any street, avenue, alley, bridge or vacant lot; provided, that this section shall not apply to any apparatus or vehicle belonging to the Fire Department. 9.10.030 Hindering Fire Department – Obstructing fire hydrant.
No person shall place or cause to be placed upon or about any fire hydrant any rubbish, building material, or fence, or delay the Fire Department in the performance of its duties in case of fire, nor shall any person hitch or cause to be hitched to any fire hydrant any animal or animals, nor fasten to the same any guy ropes or brace, nor back nor park any wagon, truck, automobile or other vehicle within 15 feet of any such hydrant. 9.10.040 False alarms.
It shall be unlawful for any person or persons to make or sound or cause to be made or sounded or by any other means create any false alarm of fire without reasonable cause. (Ord. 1556 § 3. Code 1990 § 1-423)
9.10.050 Apparatus – Use without authority.
No person shall use any fire apparatus or equipment for any private purposes nor shall any person willfully and without proper authority remove, take away, keep or conceal any tool, appliance or other article used in any way by the Fire Department. (Ord. 1556 § 3. Code 1990 § 1-424)
9.10.060 Resuscitator.
The resuscitator shall not be removed from the fire truck by any unauthorized person and the use thereof shall be subject to such rules and regulations as may be determined by the Fire Department. (Ord. 1556 § 3. Code 1990 § 1-425)
9.10.070 Fire truck not to be transferred.
The fire truck or any of its equipment may not be loaned, transferred or sold to any other entity without approval of the City Council. Said fire equipment shall be used for the protection of the life and property of the inhabitants of the City, living or situated within the corporate limits of said City. The Governing Body of the City may at its discretion enter into any agreement for providing mutual aid to other jurisdictions, when said mutual aid will not unduly inhibit the ability of the City to extinguish its fires. It shall be the duty of the Fire Chief or in his/her absence the Deputy Fire Chief to decide when and in what form such aid is rendered. (Ord. 1556 § 3. Code 1990 § 1-426)
9.10.080 Fire plugs.
The Fire Department of said City shall, when so directed, make such inspections, flushing and testing of fire plugs as may be required by the Governing Body of said City. (Ord. 1556 § 3. Code 1990 § 1-427)
9.10.090 Penalty.
Any person or persons violating any of the provisions of this chapter or refusing or neglecting to comply with any of the requirements thereof shall, upon conviction, be deemed guilty of a misdemeanor and fined not less than $25.00 nor more than $1,000. (Ord. 1556 § 3. Code 1990 § 1-428)
