CHAPTER 27-2
JURISDICTION AND TRANSFER

27-2-1 Jurisdiction.

(A)    The juvenile division shall have exclusive jurisdiction over a juvenile who is alleged to have committed a violation of tribal law on the Prairie Band Potawatomi Nation Reservation and who, at the time of the alleged violation:

(1)    Is a member of an Indian tribe, or

(2)    Resides on the Nation’s Reservation with a member of an Indian tribe.

(B)    The juvenile division shall have concurrent jurisdiction with the State of Kansas over a juvenile who commits a violation of law off the Nation’s Reservation and who, at the time of the alleged violation:

(1)    Is a member of an Indian tribe, or

(2)    Resides on the Nation’s Reservation with a member of an Indian tribe.

27-2-2 Transfer of a Juvenile Offender Case.

(A)    The Court in its discretion may accept or decline the transfer of a juvenile offender case from another tribal court or the State of Kansas at any stage of the juvenile offender proceedings.

(B)    If the Court accepts a request to transfer a juvenile offender case, the originating court shall be notified with a certified copy of the juvenile division’s order to transfer, accompanied by a request for a complete copy of the original court file.
