NOTICE

28-3-1 District Court

(A)    Notification of Victim.

(1)    Upon request, the Court shall provide the victim with the journal entry of each hearing in the case.

(2)    The Court shall notify the victim of the sentence imposed within 15 days (excluding weekends and holidays) of sentencing the defendant.

(3)    The Court shall provide the victim with the name and telephone number of the probation officer assigned to the case.

(4)    The Court shall provide a separate waiting area in the courthouse for the victim if such an area is available, otherwise the Court shall provide other safeguards to minimize the victim’s contact with the defendant.

(B)    Jury Instructions. If the defendant or the attorney of the defendant comments at trial on the refusal of the victim to be interviewed, the District Court shall instruct the jury that the victim has the right to refuse an interview.

28-3-2 Tribal Police Department.

The Tribal Police Department shall notify the victim of their rights pursuant to Section 28-1-4 no later than 48 hours, excluding holidays and weekends, after discovering the identity of the victim.
