18.95.010 Responsibility for enforcement.

All officials and employees of the town of Mesilla vested with the duty or authority to issue permits shall conform to the provisions of this title and shall issue no permit for uses, buildings or premises in conflict with this title, and any such permit, issued in conflict with this title shall be void. It shall be the duty of the mayor or duly authorized representative to enforce this title pertaining to the construction, reconstruction, moving, alteration or addition to any structure. 18.95.020 Violation a public nuisance.

Any structure erected, constructed, altered, enlarged, converted, moved, or maintained contrary to the provisions of the title shall be declared to be unlawful and a public nuisance. [Ord. 94-06 § 1; prior code § 11-2-13.2]

18.95.030 Town attorney.

The town attorney for the town shall, upon request by the board of trustees, immediately commence action for the abatement and removal of any violation of this title as provided by law, and shall apply to courts having jurisdiction to grant such relief to abate and remove such structure and restrain any person from erecting, building, maintaining or using property contrary to the provisions of this title. 18.95.040 Violation.

Any person violating any provisions of this title, upon conviction, shall be punished by a fine of not more than $500.00, or by imprisonment in the county jail for a term not exceeding 90 days, or by both fine and imprisonment. [Ord. 94-06 § 1; prior code § 11-2-13.4]

18.95.050 Each day a separate offense.

Each day during any portion of which any violation of this title is committed or continued by such person, shall constitute a separate offense and shall be punishable as provided. [Ord. 94-06 § 1; prior code § 11-2-13.5]

18.95.060 Interpretation.

In their interpretation and application, provisions of this title shall be held to be minimum requirements. Where this title imposes a greater restriction than is imposed or required by other rules or regulations or ordinances, the provisions of this title shall control. 18.95.070 Applicability.

The provisions of this title are applicable not only to persons, firms, agencies, and organizations, but also to all public agencies and organizations to the full extent that they may be enforceable. [Ord. 94-06 § 1; prior code § 11-2-13.7]

18.95.080 Severability.

The provisions of this title are severable and if any provision, sentence, clause, section, or part is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstance, the illegality, invalidity, unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, sentences, clauses, sections, or parts of this title or their application to other persons or circumstances.
