10.05.010 Definitions.

In addition to those definitions contained in the adopted sections of the motor vehicle laws of Oregon, the following words or phrases, except where the context clearly indicates a different meaning, shall have the meanings set forth in this section:

A. “Alley” means a narrow street through the middle of a block.

B. “Bicycle” means every device propelled by human power upon which any person may ride, having two tandem wheels either of which is over 20 inches in diameter.

C. “Bus stand” means a fixed area in the roadway adjacent to the curb to be occupied exclusively by buses for layover in operating schedules or waiting for passengers.

D. “Curb” means the extreme edge of the roadway.

E. “Holidays,” where used in this title or on signs erected in accordance with this title, mean Sundays, New Year’s Day, Memorial Day, Independence Day, Labor Day, Veterans Day, Thanksgiving Day and Christmas Day.

F. “Loading zone” means a space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of materials or freight.

G. “Park” or “parking” means the standing of a vehicle, whether occupied or not, except when a vehicle is temporarily standing for the purpose of and while actually engaged in loading or unloading.

H. “Parkway” means that portion of a street not used as a roadway or as a sidewalk.

I. “Passenger loading zone” means a loading zone reserved only for the loading or unloading of passengers and their luggage.

J. “Pedestrian” means any person afoot.

K. “Person” means every natural person, firm, partnership, association or corporation.

L. “Stop” means complete cessation of movement.

M. “Taxicab stand” means a fixed area in the roadway adjacent to the curb set aside for taxicabs to stand or wait for passengers.

N. “Traffic lane” means that portion of the roadway used for the movement of a single line of vehicles.

O. “Play street” means a street temporarily set aside for use as a playground on which usual or general vehicular traffic is prohibited. [Ord. 61-O-157 § 2.]

10.05.020 Powers of the city council.

Subject to the authority vested in the State Highway Commission, the council by resolution may establish traffic controls which shall become effective upon the installation of appropriate signs, signals or other markings. Such traffic controls may designate and regulate:

A. The parking and standing of vehicles by:

1. Classifying portions of streets upon which either parking or standing or both shall be prohibited, or prohibited during certain hours,

2. Establishing the time limit for legal parking in limited parking areas,

3. Designating the angle of parking if other than parallel to the curb,

4. Designating city-owned or city-leased property on which public parking will be permitted,

5. Designating areas within which, or streets or portions of streets along which, parking meters will be installed, and the denomination of coins to be used or deposited in parking meters;

B. Through streets, one-way streets and truck routes;

C. For trucks exceeding specified weights, streets to which they shall be restricted and streets on which they are prohibited;

D. Traffic control signals and the time of their operation;

E. Bus stops, bus stands, taxicab stands and stands for other passenger common-carrier vehicles;

F. Loading zones;

G. Turn regulations at intersections;

H. Marked pedestrian crosswalks and safety zones;

I. Play streets and the hours during which they may be so used;

J. Special speed regulations in city parks. [Ord. 61-O-157 § 3.]

10.05.030 Duties of the police department – Trees and fences.

The police department through its officers:

A. Shall cause all signs, signals, parking meters and markings necessary to traffic controls provided for by enactments of the council to be installed, marked and maintained in accordance with standards established by the State Highway Commission and nationally recognized traffic control standards (such as the Manual on Uniform Traffic Control Devices published by the U.S. Bureau of Public Roads), and may cause to be placed and maintained additional and incidental traffic control devices necessary to regulate traffic under this title or under state law, or to guide or warn traffic.

B. May trim or remove or cause to be trimmed or removed any tree, shrub or hedge which is within or extends over the street and interferes with the use of the sidewalk or roadway or obstructs a driver’s view of an intersection or traffic upon streets approaching an intersection or otherwise constitutes a traffic hazard. Trees, shrubs and hedges shall be maintained at an unobstructed height of not less than eight feet above the sidewalk and not less than 13-1/2 feet above the roadway. 10.05.040 Authority of police and fire officers.

A. It shall be the duty of the police department through its officers to enforce the provisions of this title.

B. In the event of a fire or other emergency or to expedite traffic or to safeguard pedestrians, officers of the police department may direct traffic as conditions may require notwithstanding the provisions of this title.

C. Members of the fire department, when at the scene of a fire, may direct or assist the police in directing traffic thereat or in the immediate vicinity. [Ord. 61-O-157 § 5.]
