2.30.010 Establishment of the Brownsville Parks and Open Space Advisory Board.

The City Council of the City of Brownsville hereby establishes the Brownsville Parks and Open Space Advisory Board (hereafter, the “Board”). The Board shall consist of seven members to be appointed by the Mayor. Two members of the Board may be nonresidents of the City of Brownsville, provided they shall be residents of the Brownsville Rural Fire District. The Board may appoint a third nonresident member provided the member owns property within the City limits and resides within the Brownsville Rural Fire District. At least one member of the Board shall also be a member of the Central Linn Recreational Center Board. Board members shall receive no compensation. [Ord. 794 § 1, 2023; Ord. 686A § 1, 2004.]

2.30.020 Terms of office – Vacancies.

At the first meeting of the Board, the seven members shall choose their term of office by lots as follows: two for one year, two for two years, and three for three years. Immediately thereafter, the members shall notify the Mayor and Council in writing of such allotment. Members shall hold office for three years. The Mayor shall fill any vacancy for the unexpired portion of the term, after advertising in local newspapers and the posting of public notice. Re-appointment is allowed. [Ord. 686A § 2, 2004.]

2.30.030 Removal from office.

Appointments to fill vacancies shall be for the remainder of the unexpired term. A member may be removed by the City Council, after a hearing, for misconduct or nonperformance of duty. A member who is absent for two consecutive, regular meetings without the permission of the Board Chairperson or City staff is rebuttably presumed to be in nonperformance of duty, and the City Council shall declare the position vacant unless finding otherwise following the hearing. 2.30.040 Quorum – Meetings.

Four members of the Board shall constitute a quorum. The members may make and alter rules and regulations for its government and procedures consistent with the laws of this state and with the City Charter and ordinances. It shall meet in January, March, May, September, November at such times and places as may be fixed by the Board. Special meetings may be called at any time by the chair or by four members by written or electronic notice served upon each member and posted at City Hall, at least 24 hours before the time of the proposed meeting. 2.30.050 Officers.

The Board, at its first meeting of each calendar year, shall elect a Chair and Vice Chair that shall hold office during the course of the year. [Ord. 686A § 5, 2004.]

2.30.060 Records.

The Board shall elect a Secretary, who need not be a member. The Secretary shall keep an accurate record of all Board proceedings. [Ord. 686A § 6, 2004.]

2.30.070 Powers and duties.

The Board shall have all the powers and duties which are now or which are hereafter granted to it by ordinances of this City, the Brownsville City Charter or by the general laws of the state of Oregon and the United States of America. [Ord. 686A § 7, 2004.]

2.30.080 Responsibilities.

The responsibilities of the Board are to advise the City Council and staff as follows:

A. Implementation priorities and strategies for the Brownsville Parks and Open Space Plan;

B. Improvement of existing City parks, park facilities and open space;

C. Acquisition, development, and improvement of new City parks, park facilities and open space;

D. Recommendations on recreation programs together with the Brownsville Recreation Center, as appropriate;

E. Creation of use regulations for City parks, park facilities and open space;

F. Recommendations on proposed park and recreation operating and capital budgets;

G. Repealed by Ord. 783;

H. Plan review and advise Council for all proposed parks and open spaces. [Ord. 783, 2020; Ord. 719 § 1, 2009; Ord. 686A § 8, 2004.]
