UNIFORM STANDARDS FOR PUBLIC WORKS CONSTRUCTION PROJECTS AND FEES1

15.40.010 Established.

There is established for the city a compilation of standards entitled “public works standard specifications and details,” hereinafter referred to as public works standards, which compilation shall be kept for public inspection and distribution in the office of the public works director, and which shall apply to all public works construction/improvements in the city. 15.40.015 Permit required.

Public works construction permits shall be required for any and all public works construction projects within a public easement or right-of-way in the city, including, but not limited to, water, sanitary sewer, storm drains and drainage ditches, street improvements, curbs, street lights, traffic-control devices, and for any other project which will become city-owned or maintained after completion of the project. 15.40.020 Change--Director’s authority.

The public works director is authorized and directed to develop such standards, and to make such changes therein as deemed appropriate and necessary. Such standards shall become effective when upon recommendation by the public works director to the city manager, they have been approved. The public works director shall note the date of the city manager’s approval thereon and place the same in the public works standards. Said standards shall, whenever possible, conform to such standards in effect for state, other local agencies, Oregon Department of Transportation and recognized standards published by the American Public Works Association (APWA), American Association of Highway Transportation Officials (AASHTO) and American Water Works Association (AWWA). In cases where a change in the public works standards would have a major impact or long term consequences to private property, the public works director shall present such recommendations for changes and additions to the public works standards to the city council. Upon minute action by council, such changes shall become effective as of the date noted in the minutes. (Ord. 1969 §1(part), 2013; Ord. 1764 §3, 1997; Ord. 1614(part), 1989).

15.40.030 Change--Effective date.

Any changes made in said public works standards shall not be applicable to projects for which a permit was issued prior to the effective date of said changes except as follows:

A. Emergency, Public Health, Welfare and Safety. In cases where public health, safety or welfare will be impaired, the public works director shall have the authority to take immediate action and develop such standards as is necessary to correct the deficiency.

B. Economic Impact. Where it can be shown in the course of design or construction of a public improvement or facility that a savings or benefit to the city can be achieved and such time for review by council is not available, the public works director may direct such changes to the standards. 15.40.040 Fees charged.

A fee shall be charged for all public works construction projects requiring review including, but not exclusively limited to, water, sanitary sewer, storm drains, street improvements, curbs, street lights, traffic-control devices within the right-of-way or easement of the city, and for any project which will become city-owned or maintained after completion of said project. Such fees shall not be charged for sidewalks or driveways, work performed by any public utility franchisee, work performed within an approved subdivision for which subdivision fees have been charged, or jobs performed by the city or on behalf of the city by contractors.

These fees will offset the cost to the city for its participation in approving such projects for acceptance by the city and will be set by city council resolution. (Ord. 1877 §5, 2006; Ord. 1614 (part), 1989).
