5.04.010 Definitions.

Unless the context indicates otherwise, the terms in this chapter shall have the meanings shown:

A.  "Circus" or "menagerie" means a building, tent, booth, place, space, or area where horsemanship or acrobatic feats are performed or where wild or caged animals are exhibited.

B.  "Carnival" or "exhibition" means a show or entertainment other than a circus or menagerie which has attractions, concessions, booths, sideshows, or rides.  (Ord. 2697 §2(part), 1992)

5.04.020 License required.

No person may engage in, carry on, or operate any circus, menagerie, carnival, or exhibition within the corporate limits of the city, without first obtaining a license.  (Ord. 2697 §2(part), 1992)

5.04.030 Application and issuance.

A.  A person desiring to obtain a license shall make application in the finance department on a form provided for that purpose at least two weeks prior to the event.

B.  The application shall be made and signed by the person desiring to secure such license.

C.  Applications shall be referred to the police and fire departments for investigation into the qualifications of the applicant and compliance with regulations, and then submitted with the recommendation to the finance director.

D.  The finance department shall then issue a license upon receipt of the fee as set out in the code in the "Fee Schedule."

E.  If the application for such license is disapproved, the finance department shall at once notify the applicant in writing.

F.  The applicant may appeal to the council and demand a hearing at its regular meeting thereafter and the city council shall proceed to hear and determine the appeal.

G.  Its decision in that respect shall be final.  (Ord. 2697 §2(part), 1992)

5.04.040 License--Contents.

Every license issued shall state the date of issuance and the date of expiration; the name of the person to whom issued; the amount of the fee paid; and the particular place at which the activity shall be carried on.  (Ord. 2697 §2(part), 1992)

5.04.050 License--Nontransferable.

A license granted in this chapter may be transferred only after following the application and issuance process detailed here.  (Ord. 2697 §2(part), 1992)

5.04.060 License--Fee--Exceptions.

No license fee shall be charged for any circus, menagerie, carnival or exhibition for which the net proceeds shall be devoted exclusively to charitable or religious purposes, or which shall be given exclusively by home talent.  Council shall have the power to waive the fee when the proceeds are devoted to other purposes.  (Ord. 2697 §2(part), 1992)

5.04.070 License--Display.

Licenses shall be displayed on request to any citizen or agent of the city of Cottage Grove.  (Ord. 2697 §2(part), 1992)

5.04.080 License--Revocation.

A license issued under this chapter may be revoked by the city council upon the conviction of the holder therefor for a violation of any of the provisions of this chapter, and the city council shall have the right to refuse to grant a license to any person who has been found guilty of any such violation.  (Ord. 2697 §2(part), 1992)

5.04.090 Qualifications of licensee.

All applicants must be of good moral character and must not have been convicted of a felony or of a violation of a federal or state law or ordinance of any city regulating a business which is the same or similar to the business which is the subject of the application; nor shall the holder of a license issued under this chapter knowingly employ in his licensed business a person who has been convicted of a felony or Class A misdemeanor involving moral turpitude.  (Ord. 2697 §2(part), 1992)

5.04.100 Right of entry.

Any circus, menagerie, carnival or exhibition located within the corporate limits of the city and subject to this chapter shall be open at all reasonable times to inspection by any agent of the city for violations of any ordinance of the city.  (Ord. 2697 §2(part), 1992)

5.04.110 Violation--Penalty.

Any person violating any of the provisions of this chapter shall, upon conviction thereof, be punished by a fine of not more than five hundred dollars or by imprisonment for not more than forty days or both.  Each day of noncompliance shall be considered a separate violation of this chapter.  (Ord. 2697 §2(part), 1992)
