The rules and regulations (PDF) as proposed and attached to the ordinance codified in this section and a part hereof are adopted in whole. [Ord. 556 § 1, 2023].

2.60.090 Runway crossing requirements for skydivers.

A. Notwithstanding any other provision in this chapter, the provisions of this section shall govern the runway crossing procedures and the enforcement of the runway cross procedures for skydivers making use of the designated parachute landing area adjacent to the airport.

B. With prior approval of the city, skydivers may perform parachute landings on the designated parachute landing area located adjacent to the eastern airport boundary. Without prior approval, skydivers may not make use of the parachute landing area. Parachute landing is not permitted within the airport boundary.

C. Skydivers making their way from the designated parachute landing area to hangars located to the west of the runway shall only cross the runway in accordance with the following procedure:

1. There will be only one crossing point, which will be designated by a sign on the east side of the runway located 45 feet from the edge of the runway.

2. Following completion of a jump, skydivers will proceed to and assemble at the sign, where they will check off on the crossing procedures set out in this subsection (C).

3. Prior to crossing, skydivers will check the windsock to confirm the aircraft traffic pattern and check for aircraft on downwind, base and final approach, and for the absence of aircraft moving onto the active runway. When all of the above conditions permit crossing, skydivers must also check to ensure no aircraft are engaged in a downwind landing opposite the prevailing traffic pattern before beginning to cross.

4. After completion of the above traffic check, skydivers can cross the runway so long as aircraft are not on base, final or moving from the hold-short line to the runway. When aircraft remain on the runway after landing, skydivers cannot cross until the aircraft either turn off at the runway midpoint or pass the skydivers at the designated crossing point.

5. When the traffic conditions described in subsection (C)(4) of this section permit crossing, and prior to every crossing, skydivers will announce their intentions to cross the runway on the UNICOM frequency.

6. Skydivers must cross in a group and move promptly to clear the runway.

7. All instructors, students and customers of a skydive operator will be thoroughly informed of the crossing procedures, and will acknowledge by their signature on a waiver form their understanding and their agreement to follow the procedures under penalty of their loss of skydiving privileges and/or monetary penalty.

D. Violations of the runway crossing procedures set out in subsection (C) of this section are subject to the following enforcement procedures:

1. In enforcing the runway crossing procedures and in assessing fines, skydive operators shall be responsible for the actions of their employees, instructors, and customers. A skydiver operator is an individual or business authorized by the city to make use of the city’s designated parachute landing area located adjacent to the airport.

2. Each violation of the runway crossing procedures shall subject the skydive operator to a penalty of not more than $250.00. The city shall provide the skydive operator with a written notice of violation.

3. Service of notices of violation will be complete upon personal delivery to the skydive operator, or upon mailing the notice to the skydive operator’s hangar at the airport, if the skydive operator maintains a hangar at the airport.

4. The notice of violation will contain a court date and time that will be not less than 14 days from the date of service. To contest the violation, skydivers must appear at the Creswell municipal court on the court date at the designated time. Failure to appear on the court date at the designated time will constitute a forfeiture of the fine amount and admission of the violation. In other respects, the adjudication procedures for runway crossing violations shall follow the procedures for violations in ORS chapter 153.

E. Nothing in this section excuses skydivers or skydive operators from complying with applicable rules and regulations of the Federal Aviation Administration or the rules and regulations of other governing authorities. [Ord. 479 § 1, 2014].
