9.10.010 Curfew establishment.

No minor under 18 years of age shall be in the city park, located on A Street between 4th Street and 5th Street, nor shall any minor be on the streets, highways, or alleys of Creswell in the city limits during the times set out in CMC 9.10.020. [Ord. 381 § 1, 1997].

9.10.020 Curfew hours.

For the purposes of this chapter, the applicable hours of curfew are:

A. For streets, highways, alleys or other public places not listed specifically, the hours of 12:00 a.m. until 4:00 a.m.

B. For city parks:

1. From May 1st through September 30th, the hours between 9:00 p.m. and 7:00 a.m.

2. From October 1st through April 30th, the hours between 7:00 p.m. and 7:00 a.m.

C. Exception. A minor may be exempted from curfew restrictions if the minor is accompanied by a parent or guardian and such minor is engaged in a lawful pursuit or activity which requires the presence of the minor in such public places during the hours specified in this section. 9.10.030 Parental responsibility.

No parent, guardian, or other person having legal custody of a minor under the age of 18 years shall permit the minor to be in violation of this chapter. [Ord. 381 § 3, 1997].

9.10.040 Police custody.

Any police officer is authorized to take a minor violating a provision of this chapter into custody as provided in ORS 419C.080, 419C.085 and 419C.088, and may be subjected to further proceedings as provided in ORS chapter 419C. [Ord. 381 § 4, 1997].

9.10.050 Penalties.

A. Violation of CMC 9.10.020(A) or (B) by a minor is punishable by any combination of:

1. A fine not to exceed $100.00.

2. Community service not to exceed 40 hours.

3. Any research, essay, report or educational project mandated by the judge.

B. Violation of CMC 9.10.030 by a parent, guardian, or person having legal custody of a minor is punishable by a fine not to exceed $200.00. [Ord. 381 § 5, 1997].
