3.16.010 Plats of subdivisions and partitions

Pursuant to ORS 205.350, the county clerk shall collect the following for recording and indexing:

(1) All plats containing three or fewer lots, a minimum fee of $50.00, in addition to and not in lieu of the Department of Revenue Assessment and Taxation Fund fee and the Oregon Land Information System Fund fee;

(2) All plats containing four to 20 lots, a minimum fee of $115.00, in addition to and not in lieu of the Department of Revenue Assessment and Taxation Fund fee and the Oregon Land Information System Fund fee;

(3) For each plat containing over 20 lots, an additional fee of $5.00 shall be charged for each additional lot in excess of 20 lots; and

(4) Surveyor’s post-monumentation affidavit stating that the subdivision plat has been correctly surveyed and marked with proper monuments as required under ORS 92.080(3)(b), a fee of $5.00 per page, in addition to and not in lieu of the Department of Revenue Assessment and Taxation Fund fee and the Oregon Land Information System Fund fee. 3.16.020 Vacation petitions.

Pursuant to ORS 368.341(4) the county clerk shall collect a fee of $150.00 from any party petitioning the county court for vacation of all, or part of, any lot, tract, street, alley, road, highway, common or public square. (Ord. 138 § 2, 1999)

3.16.030 Plat vacations.

Pursuant to ORS 271.230(2) for recording vacation orders or ordinances in the county deed records, the county clerk shall collect the same fee as for recording a deed. (Ord. 138 § 3, 1999)

3.16.040 Dog licenses.

Pursuant to ORS 609.100 the county clerk shall collect a fee for dog licenses as follows:

(1) For unspayed or unneutered dogs, $25.00; duplicates, $2.00;

(2) For spayed or neutered dogs, $3.00; duplicates, $2.00; and

(3) Pro-rated fees: A reduction in the $25.00 license fee of $4.00 per month for each month after July, for new county residents, newly acquired dogs, and newborn dogs eligible for rabies vaccine. (Ord. 138 § 4, 1999)

3.16.050 Marriage licenses.

Pursuant to ORS 106.045, 106.050, 106.060, 106.077, 106.120, 107.615, 205.320(5), and 205.320(6), the county clerk shall collect the following fees for the services described:

(1) Taking an affidavit for and making and issuing a marriage license and registering the return thereof, $25.00;

(2) Solemnizing a marriage during work hours, $25.00; after business hours within Crook County, $75.00; and after business hours outside Crook County, $100.00;

(3) Fees for the domestic violence fund, $25.00, shall be collected and paid over to the assistant director for services to children and families;

(4) Affidavit of proof of age when a prerequisite to the issuance of a marriage license, $10.00;

(5) A written order waiving the three-day waiting period, $10.00; and

(6) Fees for conciliation and mediation services as imposed by governing body, as provided by law, $10.00. (Ord. 138 § 5, 1999)

3.16.060 Recording.

Pursuant to ORS 205.320(1) and 205.320(4)(b) the county clerk shall collect $5.00 per page for any document required or permitted by law to be filed or recorded. In addition, as authorized by ORS 205.320(9), the county court may by order, in accordance with the process established in ORS 294.160, establish additional fees to be collected for any service the clerk may be required or authorized to perform and for which no fee is provided by law.
