9.08.010 Intent.

It is the intent of the Crook County court to enter into an intergovernmental agreement (the agreement) with the counties of Hood River, Jefferson, Deschutes, Wasco, Baker, Harney, Sherman, Grant, Gilliam, Wheeler, Wallowa, Morrow, Umatilla, Union, and Lake, as provided by ORS 190.003 through 190.085, for the creation of the Central and Eastern Oregon Juvenile Justice Consortium (CEOJJC). (Ord. 114 § 1, 1996)

9.08.020 Effective date of intergovernmental agreement.

The effective date of the intergovernmental agreement shall be following the adoption of the ordinance codified in this chapter and upon the execution of the agreement by all counties. (Ord. 114 § 2, 1996)

9.08.030 Public purpose for which CEOJJC is created.

The creation of CEOJJC will serve the following public purposes within Crook County and other communities of Central and Eastern Oregon participating in the intergovernmental agreement:

(1) The creation of a management system which develops, deploys and delivers juvenile justice services.

(2) Assistance to the Crook County court, commissions on children and families, juvenile court judges, local public safety coordinating councils and other local units of government in Central and Eastern Oregon in the development of policy and resources for juvenile justice matters.

(3) Assistance to Crook County and other Central and Eastern counties in addressing juvenile justice needs of youth and families within the jurisdiction of a juvenile court and others served by county juvenile departments.

(4) The exploration of alternatives and creation of a plan to reduce the population of youth in the state training schools and the placement of youth diverted from the training schools into community placements and programs.

(5) The creation of a self-sufficient justice system.

(6) The maintenance of cooperative agreements between counties with the Oregon Youth Authority, department of human resources, commissions on children and families and other public or private entities.

(7) The fulfillment and performance of an agreement with the department of human resources, office of alcohol, and drug abuse programs, mental health and developmental disability services, children’s services division (now the State Office of Services to Children and Families) and the department of education to develop a self-sufficient juvenile justice system in Central and Eastern Oregon.

(8) Provide cooperative and coordinated effort among the counties who are parties to the intergovernmental agreement. (Ord. 114 § 3, 1996)

9.08.040 Powers, duties and functions of CEOJJC.

(1) Powers and Authority. CEOJJC shall be empowered with all powers, rights, and duties, including expenditure of appropriate funds and retaining of personnel necessary for those functions in the coordinated delivery of the public services set forth in CCC 9.08.030 and in the furtherance of the administration of CEOJJC and the intergovernmental agreement. CEOJJC shall expressly have the power to:

(a) Make, perform, and carry out contracts of every kind and description made for any lawful purpose, with any person, firm, association or corporation, either public or private, or with any government, or any agency thereof. All contracts are subject to the public contract laws of the state of Oregon as set forth in Chapter 279 ORS.

(b) Maintain financial records and books of CEOJJC in accordance with acceptable account practices.

(c) Manage and invest moneys of CEOJJC in accordance with ORS 294.035.

(d) Hire employees, independent contractors and other staff to carry out the administration and business activities of CEOJJC.

(e) Assume annual indebtedness and liabilities not to exceed annual revenues.

(f) Dispose, divide and distribute any assets acquired by CEOJJC in accordance with bylaws adopted by its board of directors or as authorized by the board of directors.

(g) Enter into contracts to provide personal services.

(h) Implement public services, plans, goals and objectives to the extent funds are appropriate for such purposes.

(i) Approve new counties into CEOJJC.

(j) Select a CEOJJC director. Review and evaluate director performance.

(k) Adopt an annual budget to include funding allocation between counties, programs and services. Approve budget modifications.

(l) Exercise all powers, authorities and duties as authorized by the board of directors and as may be permitted by law to the extent that such power, authority and duties do not promote unilateral decisions that will affect the operating relationship of CEOJJC or availability of resources to Crook County and other counties participating in CEOJJC.

(m) Elect or appoint a board of directors, executive board and program committee.

(n) Have one or more offices to carry on all or any part of its operation or business.

(o) Exercise powers set forth in ORS 190.080. (Ord. 114 § 4, 1996)

9.08.050 Termination of CEOJJC by the Crook County court.

Crook County participation in CEOJJC may be terminated at any time upon 60 days’ advance written notice to CEOJJC or as otherwise provided by the terms of the intergovernmental agreement. (Ord. 114 § 5, 1996)
