1.12.010 Established.

The official seal of the city shall be as originally affixed to the ordinance and codified in this chapter.

1.12.020 Definitions.

(1) The “city seal” and “city logo” are those adopted by the Gladstone City Council and constitute the intellectual property of the city.

(2) “City insignia” includes the city seal and city logo, as well as any materials that include the city seal or city logo including but not limited to city flags, banners, website banners, letterhead, business cards, and other emblems as approved by the City Administrator.

1.12.030 Designation of city logo.

The logo of the City of Gladstone, Oregon, shall be as follows:

1.12.040 Use of city seal, logo and insignia.

(1) The city seal, logo and insignia are the property of the City of Gladstone. The seal is used for purposes of certifying official records and instruments of the City of Gladstone. The logo is a graphic symbol used to identify city programs, initiatives, partnerships, and correspondence.

(2) The City Recorder shall be the official custodian of the city seal. The City Recorder or designee is authorized to use the city seal on any ordinance, resolution, proclamation, commendation, certificate or other instrument approved by the City Council or executed by the Mayor or other city officials; and to authenticate official documents in the conduct of official city business.

(3) The City Administrator or designee shall be the official custodian of the city logo and city insignia. The City Administrator or designee is authorized to determine the appropriate use of, and to ensure that, the city logo and insignia are used only on documents and property, and for programs that reflect official city business, ownership, or endorsement, and to identify persons duly elected or appointed to a city position or office. In deciding the manner by which the city’s logo and insignia may be utilized, the City Administrator shall endeavor to protect the city’s brand, reputation and credibility by preventing use of the insignia in such a manner as to suggest city endorsement of commercial events, political issues, products and other uses that are prohibited by law.

1.12.050 Prohibited uses of city seal, city logo and city insignia.

It is unlawful for any person to make or use the city seal, the city logo, any city insignia, or any cut, facsimile or reproduction thereof, for any purpose other than for the official business of the city, its Council, officials, or departments, without the express consent of the City Administrator or the Administrator’s designees.

1.12.060 Penalties.

(1) Every person who uses or allows to be used any reproduction of facsimile of the city seal, logo, or insignia in violation of this chapter is guilty of a Class “A” infraction, and punishable by a fine not exceeding $750.00.

(2) Nothing in this chapter is intended to, or otherwise prevents, the city from using any other available civil and/or criminal remedies allowed by law to protect the city seal, city logo, and city insignia from improper or illegal use or uses otherwise not regulated by this chapter.
