2.25.010 Creation and term of office.

The Halsey planning commission is hereby created. The commission shall consist of five members at large, appointed by the city council, and one member of the city council who shall serve as an ex officio nonvoting member also appointed by the city council.

The term of office of the appointed members shall be four years or until their successors are appointed and qualified, and their terms shall be staggered so that the term of office of not more than two positions will expire in the same year. The terms of commissioners in office at the effective date of the ordinance codified in this chapter shall not terminate, but they shall serve out their respective terms unless sooner removed as may be provided by city ordinance or other laws. Any vacancy in said commission shall be filled by appointment made by the council for the unexpired portion of the term. [Ord. 341 § 1, 1997.]

2.25.020 Qualifications.

No fewer than three members at large shall be residents of the city of Halsey. There may be up to two members who are from outside the city of Halsey as long as their legal residence is within the area of mutual interest as established by Exhibit “B” of the urban growth boundary management agreement between the city of Halsey and Linn County. Each member of the commission shall be a qualified elector within the meaning of the state constitution. Also, the local commission member will have resided in the six-mile area of mutual interest for six months before an appointment is made. All applicants will be interviewed by the Halsey city council. [Ord. 341 § 2, 1997.]

2.25.030 Powers and duties.

(1) The planning commission shall base its decisions relating to land use, public facilities, transportation, housing and related matters on the Halsey comprehensive plan and upon land development ordinances intended to implement the plan.

(2) The planning commission shall conduct an overall review of the Halsey comprehensive plan at the time of periodic review as scheduled by the state of Oregon, or as directed by the city council and shall recommend to the city council amendments to the plan.

(3) The planning commission shall recommend, after public hearing, to the city council specific amendments to the Halsey comprehensive plan that may be proposed from time to time by the public, the planning commission, or the city council. Said amendments shall be based upon further studies or changed community priorities or conditions.

(4) The planning commission shall formulate and recommend to the city council various programs, policies, and ordinances intended to implement the Halsey comprehensive plan.

(5) The planning commission shall prepare or cause to have prepared various studies and plans related to community or neighborhood development problems, issues, and needs.

(6) On request, the planning commission shall review and submit recommendations to the city council regarding city boundary changes or any public program for the acquisition and development of public facilities and transportation.

(7) The planning commission shall review and process all proposed subdivisions and partitions as provided for in the Halsey subdivision ordinance.

(8) The planning commission shall review and process all variance and conditional use applications as provided for in the Halsey zoning ordinance.

(9) The planning commission shall conduct hearings, prepare and maintain accurate minutes and records of these hearings, and perform other duties relating to the city’s land development ordinances, including zoning and subdivision regulations as may be prescribed by state law, county law, and city ordinance.

(10) At the request of the city council, the planning commission shall perform duties related to some aspect of community planning and development.

(11) The planning commission shall submit an annual report to the city council, by the first day of February, each year, on the activities and proposed activities of the planning commission.

(12) The planning commission shall forward copies of the minutes of its proceedings to the city council on a monthly basis.

(13) The planning commission shall encourage cooperation and coordination with public and semi-public agencies, civic and private organizations and other individuals and groups having an interest in the development of the city and its surrounding area.

(14) The planning commission shall also have all the powers which are now, or may hereafter be given to it, under the general laws of the state of Oregon, or the charters or ordinances of the city of Halsey. [Ord. 341 § 3, 1997.]

2.25.040 Transmittal of information to city council.

All recommendations and actions taken by the planning commission, including minutes, shall be in writing. These will be forwarded to the city council after being dated and signed by the chairman of the planning commission. [Ord. 341 § 4, 1997.]

2.25.050 Appeals and review of planning commission decisions.

Within the time specified by the applicable city ordinances or state law, any person who testified before the planning commission on a matter may appeal the planning commission’s decision to the city council. Such appeals must be in writing, identify the decision being appealed, and state with particularity the reasons why the planning commission erred, within 15 days of the decision. 2.25.060 Election of chairperson and vice-chairperson.

The commission, at its first regular meeting in January, shall elect a chairperson and a vice-chairperson who shall hold office for one year. The commission shall elect a chairperson and vice-chairperson each year thereafter. [Ord. 341 § 6, 1997.]

2.25.070 Secretary.

The commission shall appoint a secretary who need not be a member of the commission. The secretary shall keep an accurate record of all commission proceedings. [Ord. 341 § 7, 1997.]

2.25.080 Meetings.

(1) Three members of the planning commission appointed by the city council shall constitute a quorum.

(2) The planning commission may make and alter rules and regulations for its government and procedure consistent with the laws of the state of Oregon and with the charter and ordinances of the city of Halsey.

(3) The planning commission shall meet at least once each calendar quarter, at such time and place as may be fixed. All public meetings of the planning commission shall be open to the public.

(4) Meetings other than at regularly scheduled times may be announced at a prior meeting and thereby be made part of the meeting records. Special meetings may be called at any time by the chairperson or by two members, by notice served upon each member of the planning commission at least 24 hours before the time specified for the proposed meeting. Notice of a previously unannounced meeting shall be posted at least 24 hours prior to the meeting. [Ord. 341 § 8, 1997.]

2.25.090 Adoption of state statutes.

The provisions of ORS Chapter 227, as amended, which are not in conflict with any portion of the ordinance codified in this chapter, are adopted by this reference and made a part of this chapter. [Ord. 341 § 9, 1997.]
