10.15.010 Title.

This chapter may be cited as the “Special Pets Control Ordinance of the City of Halsey.” [Ord. 426 § 3, 2018; Ord. 321 § 1, 1994. Formerly § 5.25.010.]

10.15.020 Purpose.

The purpose of this chapter is to regulate the keeping and raising of special pets within the city limits of Halsey. [Ord. 426 § 3, 2018; Ord. 321 § 2, 1994. Formerly § 5.25.020.]

10.15.030 Definitions.

“Special pets” means miniature horses no taller than 37 inches, pot-bellied pigs no larger than 18 inches in height and 95 pounds in weight, and pygmy goats. [Ord. 426 § 3, 2018; Ord. 321 § 3, 1994. Formerly § 5.25.030.]

10.15.040 Regulations.

(1) No more than one special pet as defined in this chapter per 80-foot by 100-foot lot, or 8,000 square feet of land.

(2) Special pets shall:

(a) Be confined by fence or leash to the property of the person keeping or maintaining them or to the property of another if such other person has given express permission;

(b) Be subject to all conditions of existing leash laws.

(3) Such special pets shall have access to an enclosed structure sufficient to protect them from wind, rain, snow or sun and which has adequate bedding to protect against cold and dampness. Confinement areas must be kept clean and free from waste or other contaminants.

(4) Notwithstanding of any of the above, no such pet shall be allowed in a public place, such as the park, without the approval of the city council.

(5) All requests for the keeping and raising of special pets shall make application to the city council, and may be subject to other provisions made by council at that time. [Ord. 426 § 3, 2018; Ord. 321 § 4, 1994. Formerly § 5.25.040.]

10.15.050 Nuisance.

No person shall allow the keeping or raising of special pets to create an unsanitary condition resulting in a nuisance. Any such nuisance may be abated through the provisions of the city’s nuisance ordinance. [Ord. 426 § 3, 2018; Ord. 321 § 5, 1994. Formerly § 5.25.050.]

10.15.060 Penalty.

Violation of any provision of this chapter is punishable by a fine not to exceed $300.00. [Ord. 426 § 3, 2018; Ord. 321 § 7, 1994. Formerly § 5.25.060.]
