LIVESTOCK AND FOWL

6.05.010 Definitions.
A. “City” means the city of Rainier.
B. “Council” means the common council of the city.
C. “Person” means every natural person, firm, partnership, associations or corporation.
D. “Livestock” means cattle, sheep, horses, goats, swine, rabbits and any other fur bearing animal bred and maintained commercially or otherwise within pens, cages and hutches.
E. “Fowl” means duck, chickens, geese, turkeys, pigeon or other like bird.
F. “Keep” means to provide food or shelter of a permanent or semipermanent nature. (Ord. 883 § 1, 1985)
6.05.020 Restrictions on keeping certain livestock and fowl.
No person shall keep, harbor or maintain any livestock or fowl, domesticated or otherwise, in this city, or permit the same to be kept, harbored or maintained upon premises owned, occupied or controlled by said person except under the conditions prescribed by this chapter. (Ord. 883 § 2, 1985)
6.05.030 Council approval required.
Any person desiring to keep, harbor, or maintain any such livestock or fowl shall submit to the council written request to keep, harbor or maintain any such livestock or fowl. The council shall cause a record to be made of its approval or disapproval. (Ord. 883 § 3, 1985)
6.05.040 Livestock at large.
No person owning or having possession or control of any livestock shall allow such to run at large or remain at large upon any street, alley, park or public place within the city of Rainier. (Ord. 883 § 4, 1985)
6.05.050 Fowl at large.
No person owning or having possession or control of fowl shall permit such fowl to run at large or remain at large upon any street, alley, park, public place or property within the city limits of the city of Rainier. (Ord. 883 § 5, 1985)
6.05.060 Violation – Penalty.
A. Any person violating the provisions of this chapter, upon conviction, shall be punished by a fine not to exceed $100.00.
Each violation of a provision of this chapter shall constitute a separate offense.
The punishment for the second and subsequent violations of any provision of this chapter shall be a fine not to exceed $200.00.
B. In addition to such other penalty as may be imposed, the municipal judge may require restitution from the owner of any livestock and/or fowl for physical injury or property damage done by such livestock and/or fowl. (Ord. 883 § 6, 1985)
