5.10.010 Authorization.

An organization organized and existing for charitable, benevolent, eleemosynary, humane, patriotic, religious, philanthropic, recreational, social, educational, civic, fraternal or other nonprofit purposes is hereby authorized to play or conduct social games in an establishment owned by or used for the conducting or operation of their nonprofit business. [Ord. 85-102-O § 1].

5.10.020 Notification.

Prior to its commencement of operation of bingo or lotto, an organization shall notify the Oregon State Corporation Commissioner of its proposed operation and shall supply a certification of its exemption from payment of federal income taxes as a charitable, fraternal or religious organization. A copy of the authorization by the Corporation Commission shall be filed with the city recorder. [Ord. 85-102-O § 2].

5.10.030 License required.

No person shall offer facilities for the playing or conducting of a social game (except in a private home) without having first paid the fee provided herein and having obtained a license to do so in the amount, manner and form hereinafter provided.

By authorization of the council, the fee may be waived and a license will be issued. [Ord. 85-102-O § 3].

5.10.040 Games in private homes.

Social games may be conducted and are authorized in a private home where no house player, house bank, or house odds exist and there is no fee charged or house income derived from the operation of the social game. [Ord. 85-102-O § 4].

5.10.050 Violation – Penalty.

Any person or persons, partnership, association, corporation or any other entity which plays, allows to play or conducts any social game in violation of this chapter or without first having applied for and obtained a license as required by this chapter shall be declared guilty of a violation of this chapter and shall, upon conviction, be punished by a fine in the sum not to exceed $1,000. 5.10.060 Fee.

The license fee for any social gaming taxes pursuant to this chapter shall be computed the same as the occupation tax of the city. [Ord. 85-102-O § 6].

5.10.070 Application.

Licenses for social games shall be applied for at least 10 working days prior to commencement of the games. [Ord. 85-102-O § 7].
