13.25.010 Need for regulation.

During the summer months and at other times of emergency there is or may be need for reduced use of water in the city of Rogue River water supply system to regulate irrigation and other uses of water at all times by all parties; and whereas there may develop such emergencies as failure of the well automatic system or the failure of pumps or other parts of the system. 13.25.020 Definitions.

For the purpose of this chapter, the following terms, words, phrases and their derivations shall have the meaning given herein.

“City” is the city of Rogue River.

“Person” is a firm, partnership, association, corporation, including a municipal corporation and/or subdivisions of the state of Oregon, company or other organization of any kind.

“Water” is water from the city of Rogue River water system. [Ord. 287 § 2, 1977].

13.25.030 Application of regulations.

The provisions of this chapter shall apply to all persons using city water, both in and outside the city, regardless of whether any person using water shall have a contract for water service with the city. [Ord. 287 § 3, 1977].

13.25.040 Use of water during emergency.

Whenever the city administrator finds, on the basis of the water storage reserves, that the amount of water available makes it necessary that there be a conservation of the water to protect the citizens and property in the city of Rogue River, the following water use activities shall be prohibited:

A. Watering Yards. The sprinkling, watering or irrigating of shrubbery, trees, lawns, grass, grounds, covers, plants, vines, gardens, vegetables, flowers or any other vegetation.

B. Washing Mobile Equipment. The washing of automobiles, trucks, trailers, trailer houses, railroad cars or any other type of mobile equipment, except in a commercial car wash.

C. Cleaning of Equipment, Machinery or Outdoor Surfaces. The washing and cleaning of any industrial equipment, machinery, sidewalks, driveways, filling stations, aprons, porches and other outdoor surfaces.

D. Cleaning Buildings. The washing of the outside of buildings, and this shall include dwellings or accessory buildings about or upon any premises.

E. Swimming Pools. The filling of any swimming or wading pool. [Ord. 23-418-O § 69; Ord. 95-250-O § 1; Ord. 287 § 4, 1977].

13.25.050 Exception to maintain sanitation.

The public works director, after written notice to the city administrator, shall have the authority to permit a reasonable use of water in any case necessary to maintain adequate health and sanitation standards. [Ord. 95-250-O § 2; Ord. 287 § 5, 1977].

13.25.060 Declaration of water emergency.

A. The city administrator shall cause each declaration made pursuant to this chapter to be publicly announced covering the city of Rogue River, and may cause such further declaration to be further announced in a newspaper of general circulation within the city when feasible. Each announcement shall prescribe the action taken by the city administrator, including the time it became or will become effective, and shall specify the particular use for which the use of water will be prohibited or permitted.

B. Whenever the city administrator shall find the conditions which gave rise to the water prohibition in effect are no longer in effect, the city administrator may declare the prohibition terminated in whole or in part in the manner prescribed by this chapter, effective immediately upon announcement.

C. The city administrator shall make or cause to be made a record of each time and date when any declaration is announced to the public in accordance with this chapter, and this includes the notice of termination, both in whole or in part. 13.25.070 Authority of officers.

Any vested authority of the city of Rogue River may shut off or reduce the flow of any water being used contrary to the provisions of this chapter. [Ord. 23-418-O § 71; Ord. 287 § 7, 1977].

13.25.080 Penalties.

A person convicted of the violation of any provision of this chapter shall be punished by a fine of not more than $1,000. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder. [Ord. 23-418-O § 72; Ord. 287 § 8, 1977].
