16.55.010 Violations a nuisance.

Any development, as defined by this title (see RRMC 16.05.020), initiated or maintained contrary to the provisions of this title, or without first receiving approval as required by this title, is hereby declared to be unlawful and a public nuisance, and the city attorney of the city may, or upon order of the city council shall, immediately commence action or proceedings for the abatement and removal and enjoinment thereof in the manner provided by law, and may take such other steps and apply to such courts as may have jurisdiction to grant such relief as will halt such development and return the property to its original condition, or will halt the use of the property contrary to the provisions of this title. The remedies provided for herein shall be cumulative and not exclusive. [Ord. 11-373-O § 8-7:12.100].

16.55.020 Penalties.

Any person, firm, or corporation, whether as principal, agent, employee, or otherwise, violating or causing the violation of any of the provisions of this title shall be guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not more than $1,000. Such person, firm, or corporation shall be deemed guilty of a separate offense for each and every day during any portion of which any violation of this title is committed or continued by such person, firm or corporation, and shall be punishable as herein provided for each such offense. 16.55.030 Severability and validity.

If any section, subsection, sentence, clause, or phrase of this title is for any reason held by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this title. The city council of the city of Rogue River hereby declares that it would have passed the ordinance codified in this title, and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid.
