10.32.010 Definitions.

For purposes of this chapter:

“Dynamic braking devices” means a motor vehicle brake which is activated or worked by the compression of the engine of a motor vehicle. (Ord. 07-05 § 1, 2007)

10.32.020 Prohibition.

No person shall use any dynamic braking device on any motor vehicle, except to avoid imminent danger to persons or property; however, fire engines, ambulances, aid trucks, police vehicles and other emergency vehicles shall be exempted from this prohibition. (Ord. 07-05 § 1, 2007)

10.32.030 Signs.

Prior to the effective date of the ordinance codified in this chapter, signs shall be erected by the city manager at entrances to the city in accordance with ORS 810.214 advising motorists that Silverton prohibits unmuffled engine brakes. The sign shall give the dollar amount of the maximum fine provided for violation. (Ord. 07-05 § 1, 2007)

10.32.040 Violation – Penalty.

Any person who violates any of the provisions of this chapter and any person, firm or corporation who allows or permits any motor vehicle owned and/or operated by it in violation of any of the provisions of this chapter is guilty of a violation and upon conviction of any violation hereof shall be punished according to the provisions of this code.
