13.06.010 Right of entry to premises.

With proper identification and during reasonable hours, the city or its duly authorized agents have the right to enter or leave the customer’s premises for a purpose properly connected with utility service to the premises. (Ord. 15-05 § 2, 2015)

13.06.020 Violation – Penalty.

A. With the exception of SMC 13.16.160, any person who violates any provision of the utility code shall be served by the city with written notice stating the nature of the violation and providing a reasonable time limit, but in no event longer than 30 days, for the satisfactory correction thereof. The offender must permanently cease all violations within the period of time stated in such notice.

B. Violation of SMC 13.10.020 is punishable by fines as set forth by resolution adopted by the city council. (Ord. 16-18 § 2, 2016; Ord. 15-05 § 2, 2015)

13.06.030 Violation – Continuing offenses.

Any person who continues any violation of the utility code beyond the time limit provided for in this chapter is guilty of a violation and will be fined. The violation is punishable by fines as set forth by resolution adopted by city council. Each day in which any such violation continues is deemed a separate offense. For each illicit stormwater discharge violation, each offense will increase in an amount as set by resolution. In addition, the city reserves the right to alleviate or correct the alleged violation with the cost to be borne by the violator. (Ord. 23-05, 2023; Ord. 15-05 § 2, 2015)

13.06.040 Violation – Liability for loss or damage.

Any person violating any provision of the utility code is liable to the city for any expense, loss or damage to the city, its facilities or personnel, by reason of such violation. (Ord. 15-05 § 2, 2015)
