8.30.010 Definitions.

For purposes of this chapter, the following words and phrases shall have the meanings ascribed to them by this section:

“Occupy a recreational vehicle for habitation purposes” occurs when any person or persons sleep overnight or utilize the bathroom or kitchen facilities of a recreational vehicle.

“Recreational vehicle” shall have the meaning as that term is defined in section 12.40.050 of this code. (Ord. 1093 § 1 (Exh. A), 2023)

8.30.020 Declaration of public nuisance.

The occupancy of a recreational vehicle for habitation purposes outside of recreational vehicle parks is found to create a condition tending to reduce the value of private property; to promote blight, deterioration and unsightliness; to create fire hazards; to create sewage and water safety problems; and to be generally injurious to the health, safety and general welfare. Therefore, the presence of occupancy of recreational vehicles for habitation purposes on private property in violation of this chapter is declared to constitute a public nuisance, which may be abated as provided in this code. 8.30.030 Prohibited actions.

Except as directly authorized by state law or this code, it shall be unlawful: (A) for any person to occupy a recreational vehicle for habitation purposes within the city outside of a recreational vehicle park; or (B) for any owner or person in charge of real property to permit a person to occupy a recreational vehicle for habitation purposes within the city outside of a recreational vehicle park. 8.30.040 Violation—Penalty.

Any person violating any of the provisions of this chapter shall, upon conviction thereof, be punished by a fine not to exceed five hundred dollars ($500.00). Each day is a separate offense. (Ord. 1093 § 1 (Exh. A), 2023)
