5.12.010 Adoption of Dog Control Ordinance.
A. The dog control ordinance of Washington County, Ordinance 306, enacted June 11, 1985, by the Board of County Commissioners, is by this reference incorporated into and made a part of this code as the dog control ordinance of the city, except as hereinafter specifically amended, modified or deleted, and shall be known and may be cited as the “City Dog Control Ordinance”. Violation of Ordinance No. 306, as it is now or as hereafter constituted, and any amendments thereto shall be an offense against the City.
B. One copy of Washington County Ordinance No. 306 as it is now or hereafter constituted, and any amendments thereto, shall be kept on file in the office of the city recorder. [BC 5.12.010, amended by Ordinance No. 3515, 6/10/86]
5.12.015 Amendments to Dog Control Ordinance.
Washington County Ordinance No. 306 is amended and changed in the following particulars:
A. References to “Washington County,” “Board of County Commissioners,” “County Counsel,” “District Court,” “District Judge” and other similar references are amended to read “City of Beaverton,” “Council,” “city attorney,” “municipal court of Beaverton,” “municipal judge of Beaverton” and other City positions as appropriate.
B. Section 4, relating to powers and duties of dog control officers is amended to delete paragraphs A2-A9.
C. Section 6, relating to licensing of dogs, is deleted.
D. Section 9, relating to revocation of kennel or pet shop licenses, is deleted.
E. Section 11, relating to claims for livestock killed by dogs, is amended to delete paragraphs B, C and D.
F. Section 12, the repealing clause, is deleted.
G. Section 13, relating to penalties is amended to read:
1. “A violation of any provision of the City Dog Control Ordinance, except as otherwise stated in this section, is a Class 2 Civil Infraction and shall be processed in accordance with the procedure set forth in BC 2.10.010 through 2.10.050.
2. “Each day a person is in violation of the City Dog Control Ordinance is considered a separate offense.
3. “In addition to any penalty imposed by subsection A of this section, a court may order the impoundment and destruction of any dog found to be vicious, dangerous, or found to have killed, injured or chased livestock.
4. Violation of section 5(A)5 is a Class 1 Civil Infraction and shall be processed in accordance with the procedures set forth in BC 2.10.010 through 2.10.050.
H. Section 14, relating to enforcement procedures, is deleted.
I. Section 15, relating to fees, is deleted.
J. Section 17, relating to the effective date, is deleted. (BC 5.12.015, amended by Ordinance No. 3515, 6/10/86]
