7.05.005 Short Title.

BC 7.05.005 through 7.05.040 shall be known and may be cited as the “Sidewalk Sales Ordinance” and may be referred to herein as “this ordinance”.

7.05.010 Definitions.

For the purposes of this ordinance, the following mean:

Mayor – The mayor or the mayor’s designee responsible for enforcing this ordinance.

Merchant – A person whose business is dealing in goods for profit or livelihood.

7.05.015 Annual Sidewalk Sale Authorized.

Merchants located in the City may conduct one sidewalk sale not to exceed three consecutive days per calendar year. The sidewalk sale shall be held on that part of the sidewalk immediately adjacent to the location of the merchant’s business.

7.05.020 Permit Required.

No merchant shall conduct a sidewalk sale without a permit issued by the City.

7.05.025 Permit Application and Fee.

A. A merchant desiring a permit shall apply to the mayor and pay a permit fee. The amount of the permit fee shall be set by Council resolution.

B. The application shall include the following information:

1. the name of the merchant;

2. the name of the merchant’s business;

3. the location of the business and the area of the sidewalk where the sale will be held;

4. the dates and times of the sidewalk sale.

7.05.030 Issuance of Permit.

A. The mayor shall issue the permit if the application is complete, the fee is paid and use of the sidewalk will not unduly hinder pedestrian or vehicular traffic.

B. The mayor may impose conditions on the permit to minimize obstruction to pedestrian and vehicular traffic and alleviate any danger to the public.

7.05.035 Violation.

A. Violation of this ordinance or violation of a condition of the permit constitutes a Class 2 Civil Infraction and shall be processed in accordance with BC 2.10.010 through 2.10.050.

B. Each day that a violation continues is a separate infraction.

7.05.040 Revocation of Permit.

In addition to the grounds listed in BC 2.05.054, the mayor may revoke, suspend, or refuse to issue or renew a permit when the applicant has violated conditions of a previous or present permit or provisions of this ordinance. Revocation, suspension, refusal to issue or renew a license shall be in accordance with the provisions of BC 2.05.050 through 2.05.066.
