Medium Density Residential District (RMD)

§14-901 Purpose.

The regulations of the Medium Density Residential District are designed to accommodate and encourage medium density, single-family detached suburban residential development in those areas of the Borough where public water and sewer service and adequate transportation facilities are generally available. Development is restricted to detached single-family residential development and related compatible uses designed to serve the residential community.

§14-902 Permitted Uses.

1.    Single-family detached dwellings.

2.    Group family dwellings, subject to the conditions listed in §14-2606 of this Chapter.

3.    Churches, associated parish houses, and cemeteries.

4.    Nursery, kindergarten, elementary, middle, and high schools.

5.    Parks and playgrounds.

6.    Municipal buildings and community facilities such as police and fire protection facilities, museums, libraries, etc., provided that they do not contain restaurants, cafes, membership clubs, or other places offering food, beverages, dancing, or entertainment.

7.    Family day care homes, subject to the conditions listed in §14-2607 of this Chapter.

8.    Home occupations, subject to the conditions listed in §14-2612 of this Chapter.

9.    Customary accessory uses and buildings incidental to any of the above permitted uses as provided for in Article 22 of this Chapter.

10.    Forestry activities, subject to the conditions listed in §14-2220 of this Chapter.

§14-903 Conditional Uses.

Upon approval by Borough Council, the following conditional uses are permitted, provided the use complies with the conditions listed herein and the applicable requirements specified in Article 26 of this Chapter:

A.    Group day care homes, subject to the conditions listed in §14-2608 of this Chapter.

B.    Day care centers, subject to the conditions listed in §14-2609 of this Chapter.

C.    Hospitals and nursing or convalescent homes.

D.    Golf courses, country clubs, and semi-public or private recreation areas and structures operated by membership clubs solely for the benefit of their members and not for gain, subject to the conditions listed in §14-2618 of this Chapter.

E.    Employee/executive retreats and training centers, swimming and/or tennis clubs, provided that no principal building, accessory structure, pool, tennis court, or parking area is located within 100 feet of any road right-of-way line or lot line. Additionally, swimming pools associated with these uses shall be completely enclosed with a continuous, impenetrable fence no less than 6 feet in height above the ground level and the fence shall be equipped with a lockable gate.

F.    Institutions of higher education, convents, and monasteries provided that the following conditions are met:

(1)    A minimum lot area of 3 acres for the first 300 students or enrollees plus 1 acre for each additional 100 students or enrollees.

(2)    Dormitory or residential quarters shall be located a minimum of 100 feet from any property line.

G.    Home businesses, subject to the conditions listed in §14-2612 of this Chapter.

H.    Off-street parking areas for permitted nonresidential uses, where the permitted nonresidential use is located in an adjacent zoning district, and provided that the following conditions are met:

(1)    The distance from the closest property line of the property on which the permitted nonresidential use is located to the farthest parking space in the off-street parking area shall not exceed 450 feet.

(2)    The properties on which the permitted nonresidential use and the off-street parking area are located shall be in common ownership.

§14-904 Lot Area, Building Height, and Yard Requirements.

A lot width, lot area, lot coverage, yard setback, and building height requirement of not less than the dimensions shown in the following table, unless otherwise specified heretofore in this Section or §14-903, or elsewhere in this Chapter, shall be provided for every dwelling unit and/or principal nonresidential building or use erected, altered, or established in this district.

B.    No building shall exceed two and one-half stories or 35 feet, which ever is less, unless authorized as a special exception.

§14-905 Minimum Off-Street Parking Requirements.

Off-street parking shall be provided for in accordance with Article 24 of this Chapter.

§14-906 Signs and Advertising Structures.

Signs shall be permitted in accordance with Article 25 of this Chapter.

§14-907 Supplementary District Regulations.

The supplementary district regulations in Article 22 shall apply, where applicable, as additional requirements for this district.
