2.50.010 Appointment – Term of office.

The mayor, in accordance with the provisions of this code and state law, shall appoint a qualified person to serve as chief of police, to be designated as the chief of police. The person so appointed shall continue in office until his successor is appointed and qualified but may be removed at any time by the mayor with the consent of the city council. 2.50.020 Power and responsibilities.

The chief of police shall, in the discharge of his duty, have the same powers and responsibilities as sheriff and constable; he shall suppress riots, disturbances, and breaches of the peace, and apprehend all persons committing any offense against the laws of the state or the ordinances of the city. He shall at all times diligently and faithfully discharge his duties and enforce all ordinances and regulations of the city for the preservation of peace, good order, and the protection of the rights and property of all persons and in so doing shall have all of the powers, rights and duties conferred as set forth under Sections 10-3-913 through 10-3-915, Utah Code Annotated 1953. 2.50.030 Police department established.

There is hereby created a police department which shall consist of the chief of police who shall be the chief of police and such other officers and employees as may be provided for from time to time by the city council. [Code 1988 § 6-1-2.1].

2.50.040 Duties and powers – General.

The peace officers of the city shall have the same powers and responsibilities as constables. It shall be the duty of the police force in the city at all times to preserve the public peace, prevent crime, detect and arrest offenders, suppress riots, protect persons and property, remove nuisances existing in the public streets, roads, and highways, enforce every law relating to the suppression of offenses, and perform all other duties required of them by ordinance or resolution of the city council and in so carrying out their responsibilities shall have the power and authority, without process, to arrest and take into custody any person who shall commit or threaten or attempt to commit in the presence of the officer, or within his view, any breach of the peace, or any offense directly prohibited by the laws of this state or city. 2.50.050 Duties and powers – Specific responsibilities.

A. Enforce Traffic Regulations. It shall be the duty of the police department to enforce the street traffic regulations of the city and of all state vehicle laws applicable to street traffic in the city (see HMC Title 10), to make arrests for traffic violations, to investigate accidents, and to cooperate with the officials of the city in the administration of the traffic laws and in developing ways and means to improve traffic conditions. B. Install Traffic Control Devices. The chief of police shall place and maintain such traffic devices as may be required by the ordinances of this city, or as he may deem necessary to regulate, guide, or warn traffic under the traffic ordinances of this city. [Code 1988 § 6-1-2.3].
