A. Any application for an alcoholic beverage license which does not meet the requirements of this chapter or for which a function listed at Section 5.10.040(E) has issued a negative recommendation based on the provisions of this chapter may be denied.

B. Any application for renewal of an alcoholic beverage license which no longer meets the requirements of this chapter or for which a function listed at Section 5.10.040(E) has issued a negative recommendation based on the provisions of this chapter may be suspended for thirty days providing the applicant an opportunity to correct the deficiency.

C. Any suspended alcoholic beverage license which continues to fail to meet the requirements of this chapter or for which a function listed at Section 5.10.040(E) continues to issue a negative recommendation based on the provisions of this chapter on the thirty-first day shall be revoked.

D. Notification of the denial, suspension and revocation shall be in accordance with the provisions of Section 5.04.050, Procedure for denial, suspension or revocation.

E. Applicants for alcoholic beverage license who have been denied, suspended or revoked shall have the same rights of appeal as provided in Section 5.04.050, Procedure for denial, suspension or revocation. (Ord. 10/28/2003O-12 (part))
