A. All sellers shall apply for a license to sell on the premises of a swap meet licensee. Along with the fees established herein, each seller must furnish to the swap meet licensee a signed statement containing the following information:

I certify that I am the lawful and legal owner of the listed property which is free and clear from all liens and encumbrances. I further certify that the property descriptions are true and correct and I am aware that the use of a fictitious name or furnishing false information on this form is punishable by law. I am also aware that a copy of this application shall be forwarded to the police department within twenty-four hours after it is submitted to the owner or manager of the premises where the sale is held. The application shall be picked up in person by a uniformed police officer prior to close of the business day and that said officer may, at his discretion, inspect any item available for sale if question of its origin exists.

B. A business owner with a current, valid Midvale business license in his possession may sell at a swap meet without compliance to the licensing provisions of this chapter so long as any items sold are permitted under his current business license.

C. Upon receiving the required fee and application form, the swap meet licensee shall furnish to the seller a business license permit which will allow the seller to sell for a period of time as specified in his license, subject to revocation by the chief of police for the violation of any provisions of this chapter. Appeal of revocation of any license shall be governed by the provisions of Chapter 5.04. (Ord. 10/28/2003O-12 (part); Ord. 10-20-87A § 10; Ord. 10-6-87A § 10)
