3.40.010 Purpose.

The purpose of this chapter is to set forth procedures governing disposal and purchasing guidelines and policies for the procurement of supplies, services and construction for the city and to ensure that all such purchases or encumbrances are made equitable, efficiently and economically. 3.40.020 Application.

This chapter is to cause to be established disposal and purchasing policies and procedures that would make provisions for all disposal of city property and expenditures for goods, services, and construction for the city. The policies and procedures will be applicable to the provisions of Utah state law including, but not limited to, the Uniform Fiscal Procedures Act set forth in Section 10-6-101 et seq., Utah Code Annotated 1953, as amended. Any expenditures of the city involving federal assistance funds shall comply with applicable federal law and regulations. Any expenditure of the city involving the construction, maintenance or improvement project of a class C road or work shall comply with applicable provisions of Sections 72-6-108 and 72-6-109, Utah Code Annotated 1953, as amended. No check or warrant to cover any claim against appropriations may be drawn until the claim has been processed in accordance to these established purchasing and disposal policies and procedures. 3.40.030 Repealer.

All former ordinances as parts thereof conflicting or inconsistent with the provisions of this chapter are hereby repealed. The city council may authorize the city manager to establish these policies and procedures and update them from time to time, as needed to stay current with Utah law. All policies and procedures shall be approved and adapted by the city council. [Ord. 10-121 § 11.15, 2010.]

3.40.040 Severability.

The provisions of this chapter shall be severable and if any provision thereof or the application of such provision under any circumstance is held invalid, it shall not affect any other provision of this chapter or the application in a different circumstance. [Ord. 10-121 § 11.20, 2010.]

3.40.050 Effective date.

The ordinance codified in this chapter shall become effective immediately upon publication or posting as set forth by state law. [Ord. 10-121 § 11.25, 2010.]
