2.95.010 Planning commission established.

There is hereby created a planning commission to be known as the Riverton City planning commission. The commission shall be composed of seven members, and one alternate member. It is the intent of Riverton City that the planning commission represent the interests of the community as a whole; that the membership of the commission provide balanced representation in terms of geographic, professional, neighborhood, and community interests; and that expertise relating to the development of a healthy and well planned community be sought when establishing the membership of the commission. All members of the planning commission shall be bona fide residents of Riverton City. The alternate member shall not attend all meetings of the planning commission, but shall, to the extent reasonably possible, participate in meetings of the planning commission as a voting member when another member of the planning commission is absent. 2.95.020 Appointment, term of office and removal.

Each member of the planning commission shall be appointed by the mayor of Riverton City with the advice and consent of the city council. One member shall be chosen from each of the five districts within Riverton City established herein in RCC 2.05.020(5). The alternate member and two other members of the planning commission shall be appointed from the municipal territory of Riverton City at large. They shall serve for a term of four years and until his/her successor is appointed. The terms of the members shall be staggered such that the term of the alternate and three members shall expire on January 31st of the year when the mayor takes office to serve a four-year term, and the terms of the other four regular members shall expire on January 31st of the year when three council members take office to serve a four-year term. New members shall be appointed as soon as possible following the expiration of term, but shall continue to serve until a successor is appointed.

The governing body may remove any member of the planning commission for cause. Vacancies shall be promptly filled in the same manner as the original appointment for the remainder of the unexpired term.

Planning commission members may have no more than six unexcused absences from regular planning commission meetings in a 12-month period. In the event that a commission member is absent more than six times, without being excused, in a 12-month period, such member may be removed from his or her position on the planning commission by the governing body.

In the event that the mayor and city council are unable to find someone from one of the five city districts to be appointed as a planning commissioner, a person may be chosen from any of the other districts. 2.95.030 Officers.

The planning commission shall elect annually, during a regularly scheduled meeting, a chair and a vice-chair of the commission, who shall not be allowed to succeed themselves. They will be elected from among the members of the planning commission by a majority of the total membership. The duties and responsibilities of the chair shall be to direct planning commission meetings and to keep order within those meetings. In the event that the chair is not present at the planning commission meeting it shall be the duty of the vice-chair to be responsible for the chair’s duties. 2.95.040 Quorum.

2.95.050 Compensation.

The members of the planning commission shall serve without compensation except for reasonable expenses as determined by the city council.

2.95.060 Organizations, actions and recommendations.

The members of the planning commission shall adopt rules and regulations for their organization and for the transaction of business and the conduct of their proceedings.

Reports of official actions and recommendations of the planning commission shall be public and made by the chair in writing to the governing body and shall indicate how each member of the commission voted with respect to such action or recommendation. Any member of the commission may also make a concurring or dissenting report or recommendation to the governing body.

The planning commission shall meet bimonthly and at such other times as the planning commission may determine.

2.95.070 Powers and duties.

The planning commission shall have the duties of and power to:

(1) Prepare and recommend a general plan to the city council.

(2) Recommend zoning ordinances and maps, and amendments to zoning ordinances and maps, to the city council.

(3) Administer provisions of RCC Title 18, where specifically provided for in RCC Title 18, adopted by the city council.

(4) Recommend subdivision regulations and amendments to those regulations to the city council.

(5) Recommend approval or denial of subdivision applications to the city council.

(6) Recommend approval or denial of development site plan applications to the city council.

(7) Hear and approve or deny conditional use permits.

(8) Hear, decide and/or advise on any matters as delegated or directed by the city council.
