2.05.010 Meetings.
The governing body shall hold regular meetings at its official meeting place in the West Point City Hall, 3016 West 300 North, West Point City, Davis County, Utah, on the first and third Tuesdays of each month at the hour of 6:00 p.m. prevailing official time. In the event any such official meeting date should fall on a legal holiday, the meeting shall be canceled. In the event an emergency should arise or it should appear a quorum cannot be obtained for any such official meeting, the mayor or mayor pro tem may declare the meeting continued to a day certain or until the next official meeting date; provided, that one meeting must be held in each calendar month. 2.05.020 Compelling attendance.
Should any member of the city council be absent and should his or her attendance be necessary to constitute a quorum, the council members present may compel the attendance of such absent member, and if deemed necessary, may direct the city law enforcement officer or one of his deputies forthwith to bring in such member or members under arrest. Should any member of the council, when so notified that his or her attendance is necessary to form a quorum, refuse or neglect to attend such meeting or should any member leave a council meeting without the consent of the other members of the council, when such leaving would break a quorum, he or she may, unless satisfactory excuse is given at the next regular meeting, be fined in any sum not exceeding $50.00. 2.05.030 Rules – Expulsion of member.
The city council shall determine its own rules of proceedings, may punish its members for disorderly conduct, and with the concurrence of two-thirds of the members may expel a member for cause. (Section 10-3-607, Utah Code Annotated 1953.) [Code 2000 § 2-2-3].
2.05.040 Electronic meetings.
A. Definitions. As used in this section:
1. “Anchor location” means the physical location from which the electronic meeting originates or from which the participants are connected.
2. “Electronic meeting” means a city council meeting convened or conducted by means of a conference using electronic communications.
3. “Electronic notice” means electronic mail or fax.
4. “Monitor” means to hear or observe, live, by audio or video equipment, all of the public statements of each member of the city council who is participating in a meeting.
5. “Participate” means the ability to communicate with all of the members of the city council, either verbally or electronically, so that each member of the city council can hear or observe the communication.
6. “Public hearing” means a portion of a meeting at which comments from the public will be accepted.
7. “Public statement” means a statement made in the ordinary course of business of the city council with the intent that all other members of the city council receive it.
B. Procedures. The city council may, by following the procedures and requirements of this section, convene and conduct an electronic meeting. The city council convening or conducting an electronic meeting shall:
1. Give public notice of the meeting pursuant to Section 52-4-202, Utah Code Annotated 1953, by posting written notice at the anchor location; and
2. Provide written or electronic notice to at least one newspaper of general circulation within the state, and a local media correspondent;
3. In addition to giving public notice required by subsection (B)(1) of this section, provide:
a. Notice of the electronic meeting to the members of the city council at least 24 hours before the meeting so that they may participate in and be counted as present for all purposes, including the determination that a quorum is present; and
b. A description of how the members will be connected to the electronic meeting.
C. Procedures Governing Electronic Meetings. The procedures to be followed at the electronic meeting shall be the same as those followed by the city council in a nonelectronic open and public meeting of the city council. The mayor shall conduct the meeting and the meeting shall be held pursuant to the agenda posted for that meeting. Prior to commencing the electronic meeting, an electronic link shall be established with all participants and the anchor location. Minutes shall be kept for the meeting in accordance with the requirements of the Open Meetings Law. Following passage of a motion to adjourn, the electronic link shall be terminated and the meeting shall be deemed concluded. The initial anchor location for meetings of the city council shall be the West Point City Hall located at 3200 West 300 North, West Point, Utah 84015. If the meeting is a public hearing, space and facilities will be provided at the anchor location so that interested persons and the public may attend, monitor and participate in the open portions of the meeting.
