2.60.010 Establishment of planning commission.

A. The West Point City planning commission is hereby established. The planning commission shall consist of seven members, all of whom shall be residents of the city. Members shall be selected from different professional and vocational backgrounds insofar as possible.

B. The term of office for each appointed member shall be three years and shall expire on the thirty-first of December or when the successor is appointed thereafter. Two terms of office shall expire each year with three terms expiring every third year.

C. Appointment of members to the planning commission shall be made by the mayor with the advice and consent of the city council. Appointments to fill vacancies shall be made at any time to fill the unexpired term of any member.

D. Members of the planning commission may be removed from office by the mayor with the advice and consent of the city council for misconduct or nonperformance of duty.

E. Failure of any member of the planning commission to attend three consecutive meetings of the planning commission, which absences are unexcused, shall be just cause for removal of such member.

F. Members of the planning commission shall receive approved expenses such as per diem compensation based on necessary and reasonable expenses and on meetings actually attended. [Code 2000 § 17-4-1].

2.60.020 Organization and procedures.

A. A quorum of the planning commission shall consist of four members and actions shall be taken upon a majority vote of a quorum voting.

B. The planning commission shall elect a chairperson to serve on a yearly basis with election being held the first meeting of a new year. The chairperson shall conduct all meetings of the commission and direct the work of the commission.

C. The planning commission shall elect a vice-chairperson to serve on a yearly basis with election being held the first meeting of a new year. The vice-chairperson shall function in the absence of the chairperson.

D. The planning commission may adopt policies and procedures for the conduct of its meetings, the processing of applications, and for any other purposes considered necessary for the functioning of the planning commission.

E. The minutes of each meeting of the planning commission shall be recorded and preserved in a permanent binder. All official actions shall be recorded therein. All records of the planning commission shall be available for public inspection at the planning commission office during regular business hours. [Code 2000 § 17-4-2].

2.60.030 Powers and duties.

The planning commission shall:

A. Prepare and recommend a general plan and amendments to the general plan to the city council;

B. Recommend zoning ordinances and maps, and amendments to zoning ordinances and maps, to the city council;

C. Administer provisions of the zoning ordinance, where specifically provided for in the zoning ordinance adopted by the city council;

D. Recommend subdivision regulations and amendments to those regulations to the city council;

E. Recommend approval or denial of subdivision applications;

F. Advise the city council on matters as the mayor and city council direct;

G. Hear and decide any matters that the city council designates, including the approval or denial of conditional use permits; and

H. Exercise all other powers authorized by law that are necessary to enable it to perform its function or delegated to it by the mayor or city council. [Code 2000 § 17-4-3].

2.60.040 Entrance upon land.

The planning commission or its authorized agents may enter upon any land at reasonable times to make examinations and surveys. [Code 2000 § 17-4-4].
