5.25.010 Terms and conditions.

The District may allow the use of water, on a limited basis, to qualified permittees from District-owned fire hydrants located within the District service area upon compliance with the following terms and conditions:

(1) Prior to water use, user shall procure and pay for a water use permit from the District authorizing such use on a per-vehicle basis only. Prices for water use permits shall be set according to a fee schedule adopted by the District pursuant to AWWDC 9.05.090.

The water use permit must, at all times, be kept in the vehicle to which such permit is issued.

Permits will be issued to a particular vehicle and shall not be transferred between vehicles.

Vehicles shall be inspected by District personnel prior to issuance of a permit.

(2) Each vehicle that is permitted to use water from District fire hydrants must be inspected by District staff at least once per calendar year.

(3) One-year water use permits are valid on a calendar-year basis. Each year, all one-year permits expire on December 31st.

(4) Water use permits are available and payments shall be made at the District Administrative Office during normal working hours.

(5) Cost or repairs for damages to the District fire hydrant and/or the cost to correct a situation will be billed to and shall be paid by the user. Failure to pay for such cost may result in revocation of permit.

(6) By the tenth of each month, all permittees shall submit to the District a monthly water usage report for each vehicle that used District water. The report shall include the date, gallons used and job location of all water used during the month. The District will charge for water in excess of the allowable limits in accordance with the fee schedule adopted by the District pursuant to AWWDC 9.05.090. Billings are due within 21 days from the billing date. The monthly water usage report must be kept with the permit in each vehicle.

(7) Refunds will not be made regardless of how much water is used.

(8) The user shall follow all instructions set forth in the District’s hydrant use procedures.

(9) Some fire hydrants within the District are privately owned and are not covered by this chapter. Such hydrants are to be only used for fire protection and are for no other use. [Amended during 2016 codification; Res. 2202 § 1, 1989].

5.25.020 Restrictions.

Water use permits shall not be issued for any project that requires water to be used outside the District retail service area. The District may restrict the use of water at any time during the term of the permit. [Amended during 2016 codification; Res. 2202 § 2, 1989].

5.25.030 Revocation.

Failure to follow any conditions or terms of this chapter or terms of the water use permit may result in revocation of water use permit. [Res. 2202 § 4, 1989].

5.25.035 Illegal taking of water from hydrants.

Illegal taking of water from a District fire hydrant or any private hydrant within the District service area may result in a fine, the amount of which shall be set according to a fee schedule adopted by the District pursuant to AWWDC 9.10.030. [Amended during 2016 codification; Res. 2202 § 3, 1989].
