OUTDOOR FIRES

8.32.010 Permitted uses.

No outdoor fires shall be permitted except the following:

A. Small outdoor fires for religious, ceremonial, or like social purposes;

B. Fires for instruction in the method of fighting fires, testing fire-resistant materials, or testing of fire protection equipment;

C. Fires for control of disease;

D. Fires for the disposal of bulky waste, natural vegetation or debris when due to unusual and exceptional conditions of the land whereon the same exists, relating to location and topography, no reasonable alternate means of disposal exists. The determination as to the existence of such condition as specified above shall be made by the fire department. (Ord. 3400 § 2(A), 1979.)

8.32.020 Permit – Required – Issuance authority.

All fires listed in ACC 8.32.010 shall require a prior written permit issued by the fire chief or his duly authorized agent. (Ord. 3400 § 2(B), 1979.)

8.32.030 Permit – Not required for outdoor barbecues.

No burning permit will be required under the terms of this chapter for domestic cooking of meals in outdoor barbecues and similar domestic outdoor cooking devices. (Ord. 3414 § 1, 1979; Ord. 3400 § 7, 1979.)

8.32.040 Attending and control required.

All outdoor fires shall be constantly attended by a competent person of suitable age and shall be kept under control at all times until such fire has been fully extinguished. (Ord. 3400 § 2(C), 1979.)

8.32.050 Prohibited under hazardous conditions.

The fire chief or his duly authorized agent may prohibit any and all outdoor fires whenever atmospheric conditions or local circumstances make or tend to make such fire hazardous. (Ord. 3400 § 3, 1979.)

8.32.060 Permits for burning vegetation.

A permit for burning natural vegetation may be issued for the months of February, April and October. Such permits shall be issued by the fire chief or his duly authorized agent. (Ord. 3499 § 1, 1980; Ord. 3400 § 4, 1979.)

8.32.070 Violation – Penalty.

A violation of any of the provisions of this chapter shall be a civil infraction, punishable in accordance with ACC 1.25.050, except as would be a misdemeanor pursuant to ACC 1.25.050. (Ord. 5837 § 9, 2004; Ord. 5683 § 20, 2002; Ord. 3400 § 5, 1979.)
