13.12.010 Chapter purpose.

This chapter, and the passage and enforcement thereof, is necessary for the protection of the municipally owned water supply system of the city and for the protection of the purity of such water supply. (Ord. 5851 § 1, 2004; 1957 code § 10.12.010.)

13.12.015 Definitions.

A. “City of Auburn design and construction standards” means the requirements adopted under Chapter 12.04 ACC for storm drainage, sanitary sewer, street, and water design and construction.

B. “Cross connection,” as used in this chapter, means a connection between a source of contamination and the potable water supply.

C. “Municipal water system” means the water sources, storage facilities, treatment facilities, transmission and distribution lines and all appurtenances owned and maintained by the city water utility for the purpose of distributing potable water.

D. “Washington State Department of Health,” means the state agency that has been granted authority through formal agreement with the Environmental Protection Agency to enforce the requirements of the federal Safe Drinking Water Act within the state of Washington. (Ord. 5851 § 1, 2004.)

13.12.020 Water division facilities – Trespassing on or interfering with prohibited.

It is unlawful for any person to damage, tamper with, disturb, trespass, or be upon the lands and premises of the city upon which water facilities exist including, but not limited to, intake structures, gatehouses, well buildings, treatment facilities, water storage tanks, underground vaults, pump stations and watershed properties whether or not such properties or facilities are enclosed by lawful fences. It is unlawful for any person to destroy, tamper with, or disturb any fence, gate or lock enclosing city water facilities. (Ord. 5851 § 1, 2004; 1957 code § 10.12.020.)

13.12.030 Water system equipment damage prohibited.

It is unlawful for any person to disturb, operate, interfere with or damage any water main, water pipe, valves, machinery, tools, meters or any other equipment or appurtenance belonging to, connected with or under the control of the city’s municipal water system. 13.12.035 Fire hydrant – Unlawful acts.

It is unlawful for any person to obstruct the access to any fire hydrant by placing around or thereon any stone, brick, lumber, dirt, landscaping or other material, or to open or operate any fire hydrant, or draw or attempt to draw water there-from without a permit or to willfully or carelessly damage or deface the same. 13.12.040 Cross connections prohibited.

The installation or maintenance of a cross connection which will endanger the water quality of the city’s municipal water system is prohibited. Any such cross connection now existing or hereafter installed is a nuisance and shall be abated immediately. The control or elimination of cross connections shall be in accordance with WAC 246-290-490 or subsequent revisions, together with any future manuals of standard practice pertaining to the city’s cross connection control program approved by the city and the Washington State Department of Health. The water supply will be discontinued to any premises for failure to comply with the provisions of this section. (Ord. 5851 § 1, 2004; Ord. 2789 § 1, 1974; 1957 code § 10.12.031(A).)

13.12.050 Water service to noncomplying premises – Discontinuance or refusal.

Service from the city’s water supply system to any premises upon which a private water supply system is used or operated contrary to the provisions of this chapter may be discontinued or refused. (Ord. 5851 § 1, 2004; Ord. 2789 § 1, 1974; 1957 code § 10.12.031 (B).)

13.12.060 Backflow protection required when.

Repealed by Ord 5851. (Ord. 2789 § 1, 1974; 1957 code § 10.12.031(C).)

13.12.070 Protective device requirement option.

The city reserves the right to require any customer to install, as a condition of water service, a pressure reducing valve, backflow prevention assembly, pressure relief valve or similar devices at any location where the city determines a need to protect the municipal water system. Protective devices shall comply with requirements of the Washington State Department of Health, the city’s cross connection control program and the city’s design and construction standards. 13.12.080 Public health protection.

The city shall conduct periodic inspections of both its water system and nonpublic water supply systems connected to the city’s water system in coordination with the Washington State Department of Health. The city shall from time to time promulgate, publish and enforce such rules and regulations deemed necessary to protect the municipally owned water supply from contamination. 13.12.090 Violation – Penalty.

A. Except as otherwise provided herein, any violation of the provisions of this chapter is an infraction, subject to penalties in accordance with ACC 1.25.050.

B. Any conduct that constitutes trespass, damage to or destruction of public property, theft of services or theft of property shall be punishable criminally in accordance with RCW Title 9A or ACC Title 9. (Ord. 5889 § 3, 2005; Ord. 5851 § 1, 2004; Ord. 5683 § 34, 2002; 1957 code § 10.12.050.)
