2.45.010 Purpose.

The purpose of this chapter shall be to provide the means for protecting the lives and property of the citizens of the town of Beaux Arts Village in the event of a disaster, through the creation of an emergency organization that plans for the town’s response to such a disaster and that trains for and coordinates the response to such a disaster. 2.45.020 Definitions.

“Disaster” means an event or set of circumstances that: demands immediate action to preserve the public health, protect life, protect public property or to provide relief to any stricken area within the town overtaken by such occurrences, and/or safety; or reaches such a dimension or degree of destructiveness as to warrant the mayor proclaiming the existence of a disaster or the Governor declaring a state of emergency in accordance with local and state statutes. 2.45.030 Comprehensive emergency management plan.

The comprehensive emergency management plan (CEMP) of the town of Beaux Arts Village, to the extent that it does not conflict with this chapter, shall govern disaster preparedness and disaster response in the town and shall take effect immediately upon approval by the mayor. [Ord. 367 § 3, 2009]

2.45.040 Emergency management organization.

The emergency management organization of the town is created and shall consist of the following:

(1) The mayor shall have direct responsibility for the organization, administration and operation of the emergency management organization of the town and shall either serve as or appoint a disaster coordinator.

(2) The disaster coordinator shall coordinate emergency management activities.

(3) The emergency management committee, which provides staff support, direction, and expertise in the development of the CEMP and all supporting documents. The mayor may serve as chair of the committee or may appoint the disaster coordinator to serve as chair. The CEMP may also designate the disaster coordinator as co-chair of the committee. Other membership in the committee shall be as designated in the CEMP. [Ord. 367 § 4, 2009]

2.45.050 Powers and duties of the disaster coordinator.

In preparation for a disaster and subject to the direction and control of the mayor, the disaster coordinator shall have powers and duties as follows:

(1) To have direct responsibility for disaster coordination, including, but not limited to, the organization, administration, and operation of the emergency management committee, and the resolution of questions of authority and responsibility that arise among the various members of such organization.

(2) To draft, review and recommend disaster preparedness and mutual-aid plans and/or agreements, and to cause to be prepared such ordinances and resolutions as are necessary to implement such plans and agreements.

(3) To organize and direct the training of the emergency management committee, including practice drills.

(4) To represent the town in all dealings with public and/or private agencies regarding the provision of disaster services in the event of a disaster.

(5) To designate building and/or premises as shelter for persons and/or property in the event of a disaster.

(6) To propose rules and regulations on matters reasonably related to the protection of lives and/or property injured or damaged, or likely to be injured or damaged, by a disaster. [Ord. 367 § 5, 2009]

2.45.060 Immunity from private liability.

There shall be no liability on the part of any person, partnership, corporation, the state or any political subdivision thereof who owns or maintains any buildings or premises that have been designated by the town disaster coordinator as disaster shelters, for any injuries sustained by any person while in or upon said building or premises, or as a result of any act or omission, or in any way arising from the designation of such premises as a shelter, provided such person has entered, gone upon or into said building or premises for the purpose of seeking refuge therein during a disaster. The section shall not apply to the willful acts of such owner(s) or occupant(s) or his/her servants, agents or employees. This section shall apply during a declared emergency or to any practice drill authorized by this chapter. [Amended during 2011 codification; Ord. 367 § 6, 2009]

2.45.070 Violation – Penalty.

The following offenses shall be punishable as misdemeanors by a fine not to exceed $500.00:

(1) No person shall willfully obstruct, hinder, or delay any member of the emergency management organization in the enforcement of any lawful rule or regulation issued pursuant to this chapter or in the performance of any duty required by this chapter.

(2) No person shall wear, carry or display any means of emergency identification specified by the State Department of Emergency Services, unless that person is an authorized member of the emergency management organization. [Ord. 367 § 7, 2009]
