8.25.010 Overhanging vegetation.

The town of Beaux Arts Village, Washington, may require the owner of any property therein to remove or destroy all trees, plants, shrubs, or vegetation or parts thereof which overhang any sidewalk or street, or which grow thereon in such manner as to obstruct or impair the full and free use of the sidewalk or street by the public. [Ord. 58 § 1, 1968]

8.25.020 Fire hazard.

The town of Beaux Arts Village, Washington, may require the owner of any property therein to remove or destroy all grass, weeds, shrubs, bushes, trees or vegetation growing or which has grown and died upon property owned or occupied by them and which are a fire hazard or a menace to the public health, safety or welfare. [Ord. 58 § 2, 1968]

8.25.030 Removal – Procedures.

Proceedings to require the removal of the matters described in BAVMC 8.25.010 and 8.25.020 shall be initiated by a resolution of the town council of the town of Beaux Arts Village, adopted after not less than five days’ notice to the owner, which notice shall describe the property involved and the hazardous condition and require the owner to make such removal or destruction within five days following receipt of the notice. 8.25.040 Removal – By owner.

If such removal or destruction is not made by the owner after five days following receipt of the notice, the town council of the town of Beaux Arts Village may, by resolution, require the owner of the property involved to remove or destroy the matters described in the notice given pursuant to BAVMC 8.25.030 within five days after adoption of the resolution, or be responsible for payment to the town of Beaux Arts Village for the reasonable costs of the removal or destruction thereof. 8.25.050 Removal – By city.

If such removal or destruction is not made by the owner within the time permitted by the resolution of the town council provided for in BAVMC 8.25.040, the town of Beaux Arts Village will cause the said matters to be removed or destroyed, and the cost to the town of Beaux Arts Village for such removal or destruction shall become a charge against the owner of the property and a lien against the property. 8.25.060 Notice.

Notice of the lien herein authorized shall as nearly as practicable be in substantially the same form, filed with the same office within the same time and manner, and enforced and foreclosed, as is provided by the laws of the state of Washington for liens for labor and material. [Ord. 58 § 6, 1968]

8.25.070 Statutory authority.

The ordinance codified in this chapter is passed under the authority of and pursuant to Chapter 113, Laws of 1949, State of Washington. [Ord. 58 § 7, 1968]
