5.06.010 Definitions.
In this chapter, unless the context requires otherwise, the following definitions apply:
“Promoter” means the individual or company who is sponsoring or organizing a special event.
“Special event” includes but is not limited to festivals, shows, exhibitions, fairs, rodeos, swap meets or other outdoor sales, or similar activities at which booths, stalls, concessions, rides or other activities are allowed which ordinarily would be subject to licensing under Chapter 5.04 BMC.
“Vendor” means any person or group of people who are not employed by the promoter who will be selling goods or a service at the special event. (Ord. 1809 § 1, 2000).
5.06.020 Special event fee schedule.
The promoter or sponsor of any special event shall obtain a business license following the procedures stated in Chapter 5.04 BMC. No special event permit will be required for the promoter. Any vendor participating in the special event is required to obtain a special event permit. The special event permit will be obtained through a promoter who will be responsible for producing a list of all vendors, along with such other information as is deemed necessary and convenient by the license officer, and collecting from each vendor an amount set by resolution of the city council, if any, for each day of participation. The list and moneys are due to the city no later than 24 hours prior to the special event at which time the license officer will provide special event permits for each vendor. The promoter is responsible for distributing the special event permit and making sure it is visible in the vendors booth, table, set-up, etc., for all days of participation at the special event. 5.06.030 Special event insurance – Other standards.
A. The promoter will also be responsible for providing a certificate of insurance, for general liability, naming the city as an additional insured and providing coverage in an amount not less than $1,000,000. The, city’s risk manager shall establish criteria for determining when a promoter must furnish a certificate of insurance evidencing coverage in excess of $1,000,000. The certificate of insurance is due to the city no later than two weeks prior to the event.
B. The city requires copies of any and all health permits, alcoholic beverage permits and/or requests for waivers prior to the event.
C. The city also requires a site plan showing all utilities, buildings, and all structures to be used or temporarily constructed including pedestrian and traffic access ways.
D. Police and fire department inspections and/or investigations will be conducted when necessary to enforce the Uniform Fire Code and protect the health, safety and welfare of the public.
E. The site plan and supporting information shall be routed to other city departments for review under applicable city codes and standards. Noncompliance with such codes and standards shall be grounds for denial of a special event permit.
F. Special events which would otherwise require a public area use permit pursuant to Chapter 17.20 BMC shall not be required to make separate application for such a permit when the special event permit application contains information sufficient to review the proposal for compliance with Chapter 17.20 BMC; provided, however, that nothing contained herein shall relieve the applicant of its obligation to obtain a public area use permit or its obligation to comply with Chapter 17.20 BMC. 5.06.040 Alternative annual fee for vendors.
As an alternative to the fee for vendors provided for in BMC 5.06.020, vendors may obtain an annual special event permit by paying a fee as set by resolution of the city council. Each annual special event permit shall be valid and in effect from January 1st until midnight December 31st of the year in which it is issued regardless of the date the special event permit is applied for by the vendor. 5.06.050 Persons exempt.
Vendors who have a valid business license from the city issued under the provisions of Chapter 5.04 BMC shall be exempt from obtaining a special event permit and paying any permit fee under this chapter; provided, that such persons shall be required to post their business license in their vendor booth at all times; provided, further, that vendors properly permitted under this chapter shall not be responsible for obtaining a business license pursuant to Chapter 5.04 BMC.
