10.10.001 Short title.
This title may be known and cited as the “Bothell traffic ordinance”. (Ord. 1627 § 1, 1996; Ord. 1548 § 2, 1994).
10.10.010 Model Traffic Ordinance adopted.
The Washington Model Traffic Ordinance, Chapter 308-330 WAC, referred to in this title as the “Model Traffic Ordinance” or “MTO” is hereby adopted by this reference as if set forth in full herein, except as provided in BMC 10.10.020 and 10.10.030, or as otherwise provided by this title. 10.10.040 Additional definitions.
For the purposes of this title the following words shall have the meanings ascribed to them as follows:
A. “Highway,” “road,” and “street” are synonymous terms, unless otherwise clearly delineated, meaning the entire width between the boundary lines of every way, lane, road, street, boulevard, parking lot and every way or place in the city whether publicly or privately maintained, when any part thereof is open at any time to the use of the public for the purposes of vehicular travel.
B. “Public holiday” means the following days:
1. January 1st (New Year’s Day);
2. Third Monday in January (Martin Luther King Jr.’s Birthday);
3. Third Monday in February (President’s Day);
4. Last Monday of May (Memorial Day);
5. July 4th (Independence Day);
6. First Monday in September (Labor Day);
7. November 11th (Veterans Day);
8. Fourth Thursday in November (Thanksgiving Day);
9. Day following Thanksgiving Day;
10. December 25th (Christmas Day).
C. “Garage keeper” means a person, firm, partnership, association, or corporation whose business it is to store vehicles for compensation. (Ord. 1627 § 1, 1996; Ord. 1558 § 5, 1994; Ord. 1548 § 2, 1994).
10.10.050 Designation of traffic engineer.
The director of public works is designated as the traffic engineer for the city of Bothell. (Ord. 1627 § 1, 1996; Ord. 1548 § 2, 1994).
10.10.060 Additional authority of traffic engineer.
In addition to the authority contained in RCW 46.90.265, the traffic engineer is authorized:
A. To erect signs indicating parking restrictions in accordance with adopted city parking policies;
B. To close any highway or part thereof temporarily to any and all vehicular traffic for safety reasons when hazards exist or for recreational purposes. (Ord. 1627 § 1, 1996; Ord. 1548 § 2, 1994).
10.10.070 Police impound of vehicles.
Whenever an officer impounds a vehicle pursuant to the provisions of Chapter 46.55 RCW, the officer shall complete an authorization form approved by the chief of police which specifies the section of Chapter 46.55 RCW authorizing the impound. The impound authorization form may consist of a law enforcement notice of infraction or citation for an offense for which an impound is authorized. (Ord. 1627 § 1, 1996; Ord. 1548 § 2, 1994).
