17.22.010 Purpose.
The purpose of this chapter is to enable the city to fix rates for supplying street lighting sufficient to pay for all street lighting operating and maintenance charges incurred by the city. Such rates are necessary to supply street lighting to Bothell streets for the welfare and safety of abutting property owners and occupants of real property in the city of Bothell. Street lighting is a deterrent to crime, improves access to abutting property and is provided by the city to benefit the rate payers accessed under this chapter. (Ord. 1633 § 1, 1996).
17.22.020 Service charge – Rate.
Effective for street lighting service provided on or after January 1, 2005, a service charge in the amount of $1.64 per month (payable as $3.28 every other month) shall be paid for each business premises, dwelling unit, factory-built house, manufactured home and/or mobile home in the city; provided, however, there shall be established a credit on such service charge for each customer paying for private street lighting service, in the amount of 50 percent of the total amount of the service charge; provided further, that such credit does not apply to lights or luminaries which are not primarily designed to provide illumination for the traveled portion of a street. (For example, this section shall not apply to parking lot lights or yard, building, area or residential lights installed on private property.) If a customer believes that they are entitled to such credit, the customer shall notify the public works director of the city, who shall make a determination as to whether such customer meets the intent and criteria set forth in this section. 17.22.030 Billings.
Any payments received on a consolidated utility billing shall be allocated first to payment of the street lighting service charge. Moneys collected pursuant to this chapter shall be allocated only to the purposes identified in BMC 17.22.010. (Ord. 1947 § 2, 2005; Ord. 1633 § 1, 1996; Ord. 1105 § 2, 1983).
17.22.040 Contracts authorized.
The city manager is authorized to negotiate and enter into contracts with the Puget Sound Power and Light Company and Snohomish County Public Utility District (PUD) to provide the city with street light facilities and service. (Ord. 1633 § 1, 1996; Ord. 1105 § 3, 1983).
17.22.050 Adoption of standards.
Design, construction and maintenance of street lighting systems located within the city of Bothell corporate limits shall conform to the requirements established in the Bothell Design and Construction Standards and Specifications (Bothell Standards) as adopted by city council ordinance and incorporated herein by reference, and as may later be amended.
