2.88.010 Establishment of the board – Powers – Duties.

A.    The city council hereby establishes a city of Bothell LEOFF-1 disability board. This board shall perform all functions, exercise all powers and make all determinations as defined under Chapter 41.26 RCW and Chapters 415-104 and 415-105 WAC. These shall include but not be limited to: authorizing disability leave, determining whether said disability is incurred in the line of duty or not, determine length of disability leave, termination of disability leave, retirement for disability and authorization of payment for member health benefit claims.

B.    All city of Bothell police officers and firefighters who first became members of the law enforcement officers’ and fire fighters’ retirement system prior to October 1, 1977, shall be subject to the city of Bothell LEOFF-1 disability board findings subject to appeal procedures defined in Chapter 41.26 RCW and Chapters 415-104 and 415-105 WAC. 2.88.020 Board membership, term, elections.

A.    The city of Bothell LEOFF-1 disability board shall consist of the following five members: Two members of the city council to be appointed by the mayor; one active or retired firefighter to be elected by the firefighters employed by or retired from the city; one active or retired law enforcement officer to be elected by the law enforcement officers employed by or retired from the city; and one member from the public at large residing within the Bothell city limits to be appointed by the other four members.

B.    Except as provided in subsection C below, each member, elected and appointed, shall serve a two-year term with service beginning in January. In the event of a vacancy, a successor shall be appointed or elected in the same manner as with an original appointment or election to serve the remainder of the unexpired term.

C.    The terms of city councilmember and elected representatives shall be for two years from January 1st of the year of appointment to December 31st of the second year. The terms of at large members shall commence April 1st of the year of appointment and shall expire March 31st of the second year of the individual term.

D.    Nominations and election of police and fire representatives commence every two years and are conducted by the board clerk/secretary. (Ord. 1677 § 5, 1997; Ord. 1506 § 1, 1993; Ord. 1485 § 1, 1992).

2.88.030 Meetings.

The board shall meet regularly, the second Wednesday of the month at 4:00 p.m. in the Bothell City Hall Lower Level Conference Room. If necessary, special meetings may be called by the chair or a majority of the board. Regular meetings may be canceled if there is no business pending before the board. 2.88.040 Rules of procedure.

The board shall have the powers granted by the state legislature or necessarily implied from such grant of powers in Chapter 41.26 RCW and Chapters 415-104 and 415-105 WAC. The city council empowers the disability board to develop, approve and enforce such rules, policies and procedures as necessary to transact its business. (Ord. 1485 § 1, 1992).
