10.60.010 Criminal penalties.

For violations of this title not provided for in the penalty provisions of the Model Traffic Ordinance adopted by reference in Chapter 10.10 BMC, the following apply:

A.    Unless otherwise provided by state law or the provisions of this title, the maximum penalty for an offense which is designated as a misdemeanor is a maximum fine of $1,000 or 90 days in jail or by both such fine and imprisonment. Unless otherwise provided by state law or the provisions of this title, there shall be no minimum penalty for an offense designated as a misdemeanor.

B.    Unless otherwise provided by state law or the provisions of this title, the maximum penalty for an offense which is designated as a gross misdemeanor shall be a fine of $5,000 or one year in jail, or by both such fine and imprisonment. Unless otherwise provided by state law or the provisions of this title, there shall be no minimum penalty for an offense designated as a gross misdemeanor. 10.60.020 Punishment by fine.

10.60.025 Traffic infractions.

Unless otherwise provided by state law or the provisions of this title, anyone violating any of the provisions of this title shall have committed a traffic infraction and shall be assessed a monetary penalty not to exceed $250.00. (Ord. 1627 § 1, 1996; Ord. 1386 § 4, 1990; Ord. 983 § 5, 1980).

10.60.027 Parking infraction penalty.

Notwithstanding any other provision contained within this chapter, the penalty for each violation of Chapters 10.30, 10.40 and 10.45 BMC, or any other parking sign or standard established by the city traffic engineer, for which a different penalty is not established, shall be $40.00. Each day or part of day during which the unlawful act or violation occurs shall constitute a separate offense. (Ord. 2126 § 4, 2013).

10.60.030 Reimbursement of costs.

Repealed by Ord. 1529.

10.60.040 Disposition of traffic fines and forfeitures.

All fines and forfeitures collected upon conviction or forfeiture of bail of any person charged with a violation of this title shall be paid into the general fund of the city. (Ord. 1627 § 1, 1996; Ord. 920 § 8, 1979).

10.60.050 Official misconduct.

Failure, refusal or neglect on the part of any judicial or other officer or employee receiving or having custody of any fine or forfeiture of bail, either before or after a deposit in the city’s general fund, to comply with the provisions of BMC 10.60.040 shall constitute misconduct in office and shall be grounds for removal therefrom; provided appropriate removal action is taken pursuant to state law relating to removal of public officials.
