9.50.010 SALES - RESTRICTION.

No person, except a person who is, at the time of such sale, actually employed by or engaged in operating a bona fide commercial establishment at a fixed location, shall sell to any other person any product containing a solvent having the property of releasing toxic vapors or fumes, and all sales of such product not made in or from such an establishment are hereby prohibited. 9.50.020 SALES - FOR PURPOSES OF INTOXICATION PROHIBITED.

No person shall knowingly sell or offer for sale, deliver or give away to any person, any substance containing any of the following volatile solvents, where the seller, offerer or deliverer knows or has reason to believe that the substance will be used for the purpose of inducing symptoms of intoxication, elation, dizziness, paralysis, irrational behavior, or in any manner change, distort or disturb the audio, visual or mental processes; toluene, ethyl acetate, methyl ketone, trichloroethylene, isopropanol, methyl isobutyl ketone, methyl cellosolve acetate, cyclohexanone, or any other substance which will induce symptoms of intoxication, elation, dizziness, paralysis, irrational behavior, or in any manner change, distort or disturb the audio, visual or mental processes. 9.50.030 INHALATION FOR PURPOSES OF INTOXICATION PROHIBITED - EXCEPTION.

(a)    No person shall, for the purpose of causing a condition of intoxication, inebriation, excitement, stupefaction, or the dulling of his brain or nervous system, intentionally smell or inhale the fumes from any substance containing a solvent having the property of releasing toxic vapors or fumes; provided, That nothing in this section shall be interpreted as applying to the inhalation of any anesthesia for medical or dental purposes.

(b)    No person shall, for the purpose of violating (a) use, or possess for the purpose of so using, any product containing a solvent having the property of releasing toxic vapors or fumes. (Ord. 2800 §3, 1968)

9.50.040 PENALTY FOR VIOLATION.

(a)    Any person violating any of the provisions of this chapter is a disorderly person and shall be fined not less than twenty-five dollars or more than three hundred dollars for each offense; or

(b)    Any person who violates any provision of this chapter is guilty of a misdemeanor. (Ord. 2800 §4, 1968)
