DRUG ENFORCEMENT FUND

3.44.010 Drug enforcement fund created—Expenditures.

A. There is created and established a special fund to be known as the “drug enforcement fund.”

B. The drug enforcement fund shall include deposits from the following sources:

1. All fines, forfeitures and penalties ordered paid by any court into the fund;

2. Any moneys received by the city in the form of drug abuse investigation grants;

3. All moneys allocated to the drug enforcement fund by the city council; and

4. All moneys and proceeds from the sale of property seized during drug investigations and forfeited pursuant to RCW 69.50.505 and all other applicable state and federal laws shall be deposited after amounts are deducted in accordance with state and federal laws.

C. This fund has been established for the purpose of accumulating funds for the expansion of narcotics enforcement services and the money on deposit in the drug enforcement fund shall be used for said purpose as follows:

1. For payment of all proper expenses of the investigation leading to the seizure of money or property from an investigation of controlled substance law violations, including any money delivered to the subject of the investigation by the Brewster city police department; and for payment of the costs of proceedings for forfeiture and sale, including expenses of seizure, maintenance of custody, advertising, actual costs of the city attorney, and court costs;

2. To provide funds for replenishing the petty cash drug fund;

3. To provide funds for drug awareness educational purposes;

4. To provide funds for the purchase, lease and maintenance of equipment and other items necessary for drug enforcement purposes. (Ord. 521 § 1 (part), 1991)

3.44.020 Unexpended funds.

Any unexpended funds remaining in the drug enforcement fund at the end of any budget year shall not be transferred to the general fund or otherwise lapse; rather, the unexpended funds shall be carried forward from year to year until expended for the purposes set forth in this chapter. 3.44.030 Police department revolving petty cash drug fund established.

A. There is established a revolving petty cash fund to be placed under the control of the police department and designated as the “petty cash drug fund.” The petty cash drug fund shall be a revolving cash fund in a dollar amount to be adopted by the city council by resolution.

B. The chief of police shall act as the custodian of the cash in the petty cash drug fund and shall operate the fund and keep records in accordance with the laws of the state of Washington and the practices established by the Washington State Auditor for the operation of such funds as said laws and procedures exist now or are hereafter amended.

C. The custodian of the petty cash drug fund may authorize disbursements and expenditures solely for the purposes of enforcing state statutes and city ordinances relating to controlled substances. (Ord. 521 § 1 (part), 1991)
