8.32.010 Open burning prohibited—Exception.

A. Except as specifically permitted pursuant to subsection B of this section, the burning of debris, including but not limited to leaves, brush, weeds, branches and similar material, from sunset to sunrise is unlawful.

B. The fire chief, or in his or her absence the assistant fire chief, may conduct control burns within the city limits after sundown at his or her discretion and at the property owner’s request and permission. (Ord. 815 § 1 (part), 2009: Ord. 470 (part), 1986: Ord. 441 (part), 1983)

8.32.020 Fire chief proclamation authority.

The fire chief for the city, or in his or her absence the assistant fire chief, shall have the authority to declare high fire-risk times and may, by public proclamation, limit burning throughout the entire city limits or any portion of the city at his or her discretion. If a time period is declared to be a high fire risk pursuant to this section, no burning shall be conducted in the designated portions of the city unless specifically approved by the fire chief or in his or her absence the assistant fire chief. Any persons knowingly violating any proclamation issued pursuant to this section shall be subject to the penalty set forth in Section 8.32.050. 8.32.030 All outdoor burning prohibited June through September.

Except as otherwise provided in this chapter, no outdoor burning of any kind shall be allowed within the city of Brewster between the period from June 1st through September 30th of each year. (Ord. 815 § 1 (part), 2009: Ord. 613 § 1 (part), 1995. Formerly 8.32.040)

8.32.040 Permit required.

Outdoor burning shall be by permit only. Any person desiring to burn weeds, trash, rubbish, or other materials which do not cause or create a dense smoke or odor shall first obtain an annual permit from the city clerk. Such permit shall not authorize or permit burning of any garbage, dead animals or animal parts, asphalt, petroleum products, paints, rubber products, plastics, or any other substance which may emit dense smoke or obnoxious odors and shall not authorize or permit any burning that would be in violation of burning bans issued by the State of Washington Department of Ecology, or any burning that would be in violation of other city or state laws or regulations, including mandates or proclamations of the city fire chief or assistant fire chief as authorized by Section 8.32.020. 8.32.050 Violation—Penalty.

Any person violating the provisions of any section of this chapter shall be guilty of a civil infraction for each such violation and shall be subject to a monetary penalty as established in Section 1.16.030 and in addition thereto shall be required to reimburse the city for the cost of extinguishing any fire started or continued in violation of any provision of this chapter.
