10.02.010 Washington Model Traffic Ordinance adopted.

The Washington Model Traffic Ordinance (“MTO”), Chapter 308-330 of the Washington Administrative Code (“WAC”), is adopted by reference as part of the traffic ordinances of the city of Brewster, to be codified as Chapter 10.02 of the Brewster Municipal Code, as if set forth in full herein, except as provided in Section 10.02.020 below. 10.02.020 Deletions.

The following sections of MTO are not adopted by reference and are expressly deleted: WAC 308-330-500, 308-330-505, 308-330-510, 308-330-515, 308-330-520, 308-330-525, 308-330-530, 308-330-535, 308-330-540, and 308-330-565, which relate to the regulation of bicycles; and 308-330-600, 308-330-610, 308-330-620, 308-330-630, 308-330-640, 308-330-650, and 308-330-660, which relate to the regulation of parking meters. 10.02.030 Violation deemed infraction—Exceptions.

Unless another penalty is expressly provided for by law, in the MTO or in the statutes that are adopted by reference therein, or by Chapter 46.63 RCW et seq. or by city ordinance, any person who is convicted of violating or failing to comply with any of the provisions of the MTO shall be guilty of a traffic infraction. (Ord. 553 § 3, 1992)

10.02.040 Dispositions of fines and forfeiture moneys.

All fines and forfeitures collected upon a conviction or upon forfeiture of bail of any person charged with a violation of any provisions of this chapter shall be paid into the general fund of the city. (Ord. 553 § 4, 1992)

10.02.050 Effect of repeal or amendment on prior acts.

Repeal or amendment of any ordinance by the ordinance codified in this chapter shall have no effect on previously issued citations or complaints, nor on acts committed or omitted prior to the effective date of the ordinance codified in this chapter and the repealed or amended sections shall remain in effect as to those citations, complaints and acts only.
