17.44.010 Violation—Penalties.

Any person, partnership, association, firm or corporation, or “person responsible” as that term is defined in Chapter 8.16 of the Brewster Municipal Code who violates, disobeys, neglects or refuses to comply with or resists the enforcement of this title or its provisions shall have committed a civil infraction nuisance and shall be punishable and subject to the civil fines and penalties provided for a nuisance as set forth in Chapter 8.16 of the Brewster Municipal Code, as the same exists now or may hereafter be amended. 17.44.020 Violation—Separate offenses—Additional remedies.

Every violation of this title shall be a separate and distinct infraction and, in case of a continuing violation, every day’s continuance thereof shall be deemed to be a separate and distinct infraction for which a separate civil monetary penalty may be imposed.

The assessment of one or more civil infractions under the provisions of this title shall not be construed to affect the right of the city to proceed through its proper officers with the enforcement of the provisions of this title by civil proceedings either at law or in equity in any court of competent jurisdiction.
