5.32.010 Permit – Required.

It is unlawful for any person, firm or corporation to engage in the retail sale of, or to sell, any fireworks within the city without first having obtained a permit, the fee of which shall be $10.00 per year. The permit required by this chapter is in addition to a business license that may be required under Chapter 5.01 CRMC. [Ord. 2019-01 § 2 (Exh. A), 2019].

5.32.020 Permit – Terms and conditions.

The permit for the sale of fireworks shall be issued only upon the following terms and conditions:

A. The fireworks must be distributed by a fireworks distributor with valid permission in the state.

B. The applicant must be a nonprofit organization transacting its business and affairs in the city; provided, that “transacting its business and affairs” shall mean: (1) having a business office within the city limits of Castle Rock with the appropriate licensing permits and taxes paid as may be required under Chapters 5.01 and 5.16 CRMC; and/or (2) applicant has in the course of the last calendar year done substantial charitable and/or civic activities within the city to and for the benefit of the citizens of Castle Rock, the activities to be identified and verified by proof from the applicant denoted by newspaper articles, the organization’s minutes or other similar mode, and copies must be included with the application form for the fireworks sales permit.

C. Between February 1st and March 31st, organizations must submit to the city clerk-treasurer a letter of intent to request approval for a city fireworks stand permit. Letters of intent must include a site plan of the proposed location, a letter of consent from the property owner (if applicable) and documentation of public service provided to the community. This will allow processing, with city council review for preliminary approval in April.

D. Final approval to sell fireworks within the city limits will be upon applicant providing the city with a completed fireworks application as obtained from the state and approved by the fire chief. [Ord. 2019-01 § 2 (Exh. A), 2019].

5.32.030 Sale from stands required.

All safe and sane fireworks, except toy caps, shall be sold only from stands. Such stands must conform to the regulations of the State Fire Marshal. [Ord. 2019-01 § 2 (Exh. A), 2019].

5.32.040 Number of permits.

The number of permits which the city shall issue in a calendar year shall not exceed three; provided, that an increase in the number of persons residing within the city limits shall allow additional permits to be issued according to the following schedule:

The number of persons residing within the corporate limits of the city shall be determined by reference to the latest statistics of the Washington State Census Board. [Ord. 2019-01 § 2 (Exh. A), 2019].

5.32.050 Construction.

This chapter is intended to implement Chapter 70.77 RCW and shall be construed in connection with such statute and any and all rules or regulations issued pursuant thereto. [Ord. 2019-01 § 2 (Exh. A), 2019].

5.32.060 Enforcement officer.

The city clerk-treasurer of the city or his duly authorized representative is designated as enforcement officer of this chapter and shall have the authority to revoke any license whenever licensee has violated any section of this chapter. [Ord. 2019-01 § 2 (Exh. A), 2019].
